Shortlisting Candidates for Chief Executive
The Committee was scheduled to discuss the shortlisting of candidates for the role of Chief Executive of Caerphilly County Borough Council.
The meeting was closed to the public, with the Council citing paragraph 12 of Schedule 12A of the Local Government Act 1972 as the reason for the meeting's confidentiality. This paragraph exempts information relating to any particular employee, or former employee, of, or applicant for, or former applicant for any employment with, the authority... or any officer or former officer under the authority
from being publicly available. 1
A report prepared for the meeting by the Council's Deputy Monitoring Officer and Head of Democratic Services recommended that the meeting be held in private, arguing an exemption was necessary to protect the personal data of the applicants.
The report contains personal information regarding individuals who have applied for the above-mentioned vacant post...
...whilst there is a need to ensure transparency and accountability of a Public Authority for decisions taken in relation to the appointment of senior officers, this must be balanced against the fact that this process has not yet been formally concluded and also the right of a third party to the privacy of their affairs. It is considered that this outweighs the need for the information to be made public.
The report states that the shortlisting process involves considering candidates' personal data, protected under the Data Protection Act 2018. 2
