Summary
The Hackney Council Licensing Sub Committee A met to consider a licensing application and temporary event notices. The main item for discussion was an application to vary a premises licence for Ringside, located at 22 Kingsland Road. The committee was also scheduled to discuss the procedure for licensing sub-committee hearings.
Application to Vary a Premise Licence: Ringside, 22 Kingsland Road London E2 8DA
Harry Vincent Andreetti applied to vary the premise licence for Ringside, 22 Kingsland Road, London, E2 8DA, to extend the terminal hours for all licensable activities on Thursday, Friday and Saturday until 04:00.
The report pack notes that the premises is located in the Shoreditch Special Policy Area (SPA). According to Hackney Council's licensing policy:
It is the Council's policy to refuse applications where a relevant representation is made to any application within a Special Policy Area unless the applicant can demonstrate that the proposed activity will not add to the cumulative impact being experienced in these areas.
The applicant was seeking authorisation for:
- Live Music: Thu 10:00-04:00, Fri 10:00-04:00, Sat 10:00-04:00
- Recorded Music: Thu 10:00-04:00, Fri 10:00-04:00, Sat 10:00-04:00
- Performance of Dance: Thu 10:00-04:00, Fri 10:00-04:00, Sat 10:00-04:00
- Late Night Refreshment: Thu 23:00-04:00, Fri 23:00-04:00, Sat 23:00-04:00
- Supply of Alcohol (On-sales): Thu 10:00-04:00, Fri 10:00-04:00, Sat 10:00-04:00
- Opening Hours: Mon 10:00-00:00, Tue 10:00-00:00, Wed 10:00-00:00, Thu 10:00-04:00, Fri 10:00-04:00, Sat 10:00-04:00, Sun 10:00-01:00
The current premise licence was granted on 24 November 2005 and transferred to Harry Vincent Andreetti in November 2024.
Objections to the application were received from:
- Environmental Health Authority (Environmental Enforcement) on the grounds of the prevention of public nuisance.
- The Police, on the grounds of the prevention of crime and disorder and prevention of public nuisance.
- The Licensing Authority, on the grounds of the prevention of public nuisance.
The Environmental Health Authority representative, Bart Stasica, stated that the representation was supported by evidence of previous complaints regarding fly-tipping, littering and the accumulation of waste in the area. They also noted that cigarette litter would likely be present outside the premises due to the smoking ban, and that patrons may leave behind glasses and bottles in the outdoor areas.
PC Amanda Griggs stated that the police believed the application did not identify any risks associated with the later hours applied for, nor did it identify any measures to mitigate them, and that the measures in the operating schedule are things already covered by the current conditions on the licence.
The Licensing Authority stated that given the locality of the premises in the Shoreditch Special Policy Area, in combination with the hours and activity sought, any proposed extension may place the licensing objectives at risk of being undermined.
The report pack included several options for the sub-committee to consider:
- Refuse the application.
- Approve the application, together with any conditions or restrictions which Members consider necessary for the promotion of the Licensing objectives.
If the Sub-Committee was minded to approve the application, the Licensing Officer suggested that the following additional conditions should be applied to the licence:
- The Licensee shall ensure that all staff are fully trained and made aware of the legal requirement of businesses to comply with their responsibility as regards the disposal of waste produced from the business premises. The procedure for handling and preparing for disposal of the waste shall be in writing and displayed in a prominent place where it can be referred to at all times by staff.
- The Licensee shall ensure that any contract for general and recyclable waste disposal shall be appropriate in size to the amount of waste produced by the business. The Licensee shall maintain an adequate supply of waste receptacles provided by his registered waste carrier (refuse sacks or commercial waste bins) in order to ensure all refuse emanating from the business is always presented for collection by his waste carrier and shall not use any plain black or unidentifiable refuse sacks or any other unidentifiable or unmarked waste receptacles.
- The Licensee's premises are situated in an area within which refuse may only be left on the public highway at certain times (time bands). If the Licensee's waste carrier cannot or does not comply by collecting the refuse within an hour after the close of any time band imposed by the waste authority, the Licensee must remove the refuse from the public highway and/or keep it within the premises until such time as his/her waste carrier arrives to collect the refuse.
- The Licensee shall instruct members of staff to make regular checks of the area immediately outside the premises and remove any litter, bottles and glasses emanating from the premises. A final check should be made at close of business.
- The Licensee shall provide a safe receptacle for cigarette ends to be placed outside for the use of customers, such receptacle being carefully placed so as not to cause an obstruction or trip.
- The current trade waste agreement/duty of care waste transfer document shall be conspicuously displayed and maintained in the window of the premises where it can be conveniently seen and read by persons standing in 22 Kingsland Road. This should remain unobstructed at all times and should clearly identify:
- x the name of the registered waste carrier
- x the date of commencement of trade waste contract
- x the date of expiry of trade waste contract
- x the days and times of collection
- x the type of waste including the European Waste Code
Licensing Sub-Committee Hearing Procedure
The procedure for Licensing Sub-Committee hearings under the Licensing Act 2003 was scheduled to be discussed. The document in the report pack describes the process for hearings involving premises licences, club premises certificates, provisional statements and sex establishment licences. It notes that hearings are normally held in public and are live-streamed.
