Summary

Kingsland Nursery Temporary Event Notice

Sun Cafe Premises Licence Variation
The committee was scheduled to consider an application to vary the premises licence for Sun Cafe at 261 Mare Street. Huseyin Ulus, the applicant, was seeking to extend the terminal hours for late night refreshment and the supply of alcohol until 2am from Sunday to Wednesday, and until 3am from Thursday to Saturday.
The application received objections from both the police and the licensing authority. The police expressed concerns that the existing licence conditions were insufficient to promote the licensing objectives, particularly with the extended hours. They requested a more robust set of conditions, including measures such as CCTV, an incident log, and a Challenge 25 policy2. The police also suggested that the supply of alcohol should cease 30 minutes before closing time to allow for a 'drinking up' period.
The licensing authority also objected to the extended hours, stating that they exceeded the core hours outlined in the council's licensing policy. They noted that the applicant had not proposed any additional conditions to mitigate the potential impact of the extended hours. The licensing authority also requested evidence of the current planning status of the premises to ensure that the extended hours align with planning permissions.
The Licensing Sub-Committee Report for 261 Mare Street outlined two options for the sub-committee:
- Refuse the application.
- Approve the application with additional conditions or restrictions deemed necessary to promote the licensing objectives.
Brim Burgers Dalston Ltd Premises Licence
The Licensing Sub-Committee was scheduled to review an application for a new premises licence for Brim Burgers Dalston Ltd, located at Ground Floor, 517 Kingsland Road. The applicant, Brim Burgers Dalston Ltd, was seeking authorisation for late night refreshment indoors between 11pm and 2am, every day.
Representations against the application were received from the Environmental Health Authority and the Licensing Authority, both citing concerns regarding the prevention of public nuisance. The LSC Report for 517 Kingsland Road noted that the Environmental Protection Team had conducted a site visit and found that the kitchen extract system was technologically advanced, but its performance was suboptimal due to site constraints, leading to potential odour nuisance. They recommended that the application not be granted until the kitchen extract system had been properly assessed and remedial action fully implemented.
The Licensing Authority also raised concerns that the proposed hours exceeded the core hours outlined in the council's licensing policy and that the applicant had not provided sufficient specific conditions related to the operation of the premises. They requested evidence of the current planning status of the premises and a delivery management plan detailing how the applicant intended to manage delivery services during the proposed hours.
The report outlined two options for the sub-committee:
- Refuse the application.
- Approve the application with conditions or restrictions considered necessary for the promotion of the licensing objectives.
