Summary
The Licensing Sub Committee E convened on 21 July 2025, addressing a variation to a premises licence and several temporary event notices (TENs). The committee approved the variation to a premises licence for 90 Hideout & 90 LIVE (formerly Studio 9294), permitting extended hours for licensable activities, and approved recommendations for the TENs, as objections had been withdrawn.
Variation to Premises Licence: 90 Hideout & 90 LIVE
The Licensing Sub-Committee approved the application for a variation to the premises licence for 90 Hideout & 90 LIVE, located at 92a-94 Wallis Road, Hackney, permitting extended hours for licensable activities and the supply of alcohol.
The approved hours are:
- Plays, Films, Indoor Sporting Events, Live Music, Recorded Music, Performance of Dance, Anything of a similar description: Monday to Sunday 10:00 - 22:00, Friday and Saturday 10:00 - 06:00
- Late Night Refreshment: Friday and Saturday 23:00 - 06:00
- Supply of Alcohol (On Premises): Monday to Sunday 10:00 - 22:00, Friday and Saturday 10:00 - 04:00
- Opening Hours: Monday to Sunday 08:00 - 22:30, Friday and Saturday 08:00 - 06:30
The committee also agreed to add the following conditions to the premises licence:
- The maximum number of people allowed at the premises at any one time should not exceed 800.
- The Premises Licence Holder should provide traffic marshals to manage vehicles associated with the premises.
The decision was made after considering submissions from the applicant, responsible authorities (Licensing Authority and the Police), and other persons who had made representations in support and objection to the application.
Arguments for the Variation
The applicant, Hoxton 177 Ltd, argued that the extended hours were proportionate and targeted, with a 6:00 AM close only on Friday and Saturday nights, while other days would remain as per the current premises licence. They also expressed willingness to accept a trial period and work collaboratively with responsible authorities and local residents to ensure ongoing compliance.
The applicant highlighted that they had operated 38 Temporary Event Notices (TENs) with closing times up to 6:00 AM over the past 12 months, with full compliance and no evidence of complaints or recorded incidents. They also addressed concerns about patron dispersal by detailing how marshals guide patrons to designated pick-up points for cabs, working with Uber to set a standard pick-up point on their private land.
The applicant also stated that there had been no complaints from planning regarding non-compliance throughout the 15 years the business has been running, even with extended hours and TENs.
Objections to the Variation
The Licensing Authority initially sought clarification regarding the hours sought, as they differed from those outlined in the information pack. They also noted that the applicant had offered no additional conditions or mitigations in support of the extended hours sought, and raised concerns about the premises being in close proximity to residential premises. The Licensing Authority highlighted that traffic marshals employed by the premises lacked formal enforcement powers, and recommended that the applicant should provide evidence of the current Planning status of the premises, in accordance with LP5 Planning Status1.
A Hackney Ward Councillor, speaking on behalf of local residents, objected to the application on the grounds of the Prevention of Crime and Disorder, Public Safety, Prevention of Public Nuisance and The Protection of Children from Harm. They highlighted that residential dwellings were nearby who would be affected by late night revellers arriving and leaving the premises if the variation to the premises licence is approved.
Licensing Sub-Committee Considerations
The Sub-Committee noted the applicant's willingness to close one room at 04:00 am and another at 5:00 am, and suggested that staggering the venue capacity could be imposed as a condition. They also considered a representation from one Other Person, who was not in attendance at the hearing, speaking in support of the application, citing how the venue is professionally run and held well-managed events, had respectful crowds, and consisted of a team on site that cared about the artists and community.
The Sub-Committee also noted that the Other Person had not received complaints specific to the premises' operation from local residents, but had received complaints about general noise in the area from 23:00 to 01:00.
Outcome
Ultimately, the Licensing Sub-Committee was satisfied that by granting the variation of the premises licence, the licensing objectives would continue to be promoted.
The applicant was reminded of the need to operate the premises according to any current planning permission relating to its use class and conditions, and to regularise the hours as required. The local planning authority should draw no inference or be bound by this decision with regard to any future planning application which may be made. The Premises Licence Holder was strongly encouraged to use sustainable cutlery, plates, cups, food containers, and recyclable disposable materials to avoid using single-use plastic disposable items.
Temporary Event Notices
The committee considered Temporary Event Notices (TENs) as a standing item. Both TENs at agenda item 7 had been resolved as the Responsible Authorities had withdrawn their objections, therefore they were no longer considered at the meeting. The TENs related to:
