The Kensington and Chelsea Licensing Sub-Committee was scheduled to convene to consider an application for a new premises licence for 47 Denyer Street, following the lapse of the previous licence. The application, submitted by FPI Limited, seeks to reinstate licensable activities similar to those previously permitted, including the sale of alcohol, playing recorded music, and provision of late-night refreshments. The meeting was to take into account representations received from local residents, resident associations, and the council's Noise and Nuisance Team.
Application for Premises Licence - 47 Denyer Street
FPI Limited applied for a premises licence for 47 Denyer Street, London, SW3 2LX. The applicant sought to reinstate a licence similar to one that had lapsed when Baker and Spice (London) Ltd went into liquidation on 28 July 2022. The proposed activities included:
- Sale of alcohol (on and off the premises): Monday to Saturday, 10:00 to 23:00; Sunday, 12:00 to 22:30
- Playing recorded music (indoors): Monday to Saturday, 10:00 to 23:30; Sunday, 12:00 to 22:30
- Provision of late-night refreshment (indoors): Monday to Saturday, 23:00 to 23:30
- Seasonal variations: New Year's Eve, 23:00 to 05:00 the following day
The designated premises supervisor was named as Vinay Kumar.
The applicant volunteered several steps to promote the licensing objectives1, including conditions relating to permitted hours for alcohol sales, restrictions on under 14s in the bar area, and measures to prevent nuisance from music, noise, smells, and waste.
Objections
The council received 22 representations opposing the application, including comments from Councillor Walaa Idris, Walton Street Residents' Association and Milner Street Area Resident's Association. Concerns raised in the representations included:
- Potential for noise and disturbance in a quiet residential area
- Extension of hours until 23:00 considered excessive
- Lack of engagement with residents and resident associations
- Concerns about increased crime, disorder, and anti-social behaviour
- Potential for increased traffic and noise from delivery scooters
- Litter concerns
Residents suggested the following measures if the licence was to be granted:
- Alcohol to be served only to seated customers taking substantial table meals
- Closing time of 22:00
- No alcohol to be taken from the premises
- No takeaway service
- Restrictions on music and amplified sound
- Designated smoking area
- Meetings with local residents' association and ward councillors
- Restrictions on rubbish disposal times
- A dispersal and external management plan
Noise and Nuisance Team Representation
The council's Noise and Nuisance Team also submitted a representation, raising concerns about the lack of detail on how the applicant would prevent public nuisance, given that the end user of the premises was not known. The team requested the following conditions:
- No music or amplified sound to cause nuisance to neighbouring dwellings
- No noise or vibration from plant operations to cause nuisance
- No smells from cooking processes to cause nuisance
- Display of notices requesting patrons to respect local residents
- Waste to be presented no more than 30 minutes before collection time
- Restrictions on depositing rubbish and refuse collections between 23:00 and 07:00
- Restrictions on deliveries between 23:00 and 07:00
The applicant, through Jack Spiegler of Thomas & Thomas Partners, confirmed agreement with the conditions proposed by the Noise and Nuisance Team.
Planning Considerations
George Weir, Planning Assistant, confirmed that the site was in use as a class E unit2, with no planning restrictions in place, and raised no objections to the licence in planning terms.
