PC Jinelle Caldinez objected on behalf of the Metropolitan Police on the grounds of the Prevention of Crime and Disorder and Public Safety.

PC Caldinez has concerns that the location is situated in close proximity to Portobello Road and Rampage sound system. Photographs of Portobello Road from last year's Carnival have been included to highlight the crowd levels and the difficulty of having a bar set up in a congested area.

PC Caldinez stated that Mr Bolton had not complied with clauses 25.4 and 25.5 of The Royal Borough of Kensington and Chelsea's Licensing Policy as not enough information had been provided detailing how the TEN would be managed, and that no risk assessment had been submitted. PC Caldinez also stated that Mr Bolton had not provided evidence that a street trading licence had been obtained under the London Local Authorities Act 1990.

Mr Philip Richardson objected on behalf of the Environmental Health Noise and Nuisance Team on the grounds of Public Safety. Mr Richardson stated that the TEN is situated in a part of Elgin Crescent, in close proximity to the junction of Portobello Road close to the parade route on Ladbroke Grove, an area well known for heavy congestions. Mr Richardson also stated that Mr Bolton had not provided a Risk Assessment or Event Management Plan, or evidence that a street trading licence had been granted.

Statement of Licensing Policy

The report pack included extracts from the council's statement of licensing policy, which states that the Licensing Authority must carry out its licensing functions so as to promote the four licensing objectives:

  • The prevention of crime and disorder
  • Public safety
  • The prevention of public nuisance
  • The protection of children from harm.

The statement also includes specific guidance on Temporary Event Notices, significant/major events and the Notting Hill Carnival. With regards to Notting Hill Carnival, the policy states:
