PC Jinelle Caldinez objected on behalf of the Metropolitan Police on the grounds of crime, disorder and public safety.

The TEN is located in Westbourne Park Road which sits on the main parade route, and a high density footfall forms on this footprint.

PC Caldinez was concerned that any premises selling alcohol on Westbourne Park Road within such a busy area could have a negative impact on the crowd flow, potentially leading to congestion and impacting public safety. PC Caldinez stated that Mr Lewis had not complied with clauses 25.4 and 25.5 of The Royal Borough of Kensington and Chelsea's Licensing Policy as not enough detail had been provided detailing how the TEN would be managed, and no risk assessment had been submitted. PC Caldinez also stated that Mr Lewis had not provided evidence that a street trading licence had been obtained under the London Local Authorities Act 1990. A copy of the police objection was included as Appendix B - Police Objection.

Mr Philip Richardson objected on behalf of the Environmental Health Noise and Nuisance Team on the grounds of public safety. Mr Richardson believed public safety would be undermined as the TEN is situated on the forecourt area in a very congested area of the carnival footprint and very close to the parade route. He stated that the TEN was likely to exacerbate this congestion by drawing and holding people at the site, which could negatively affect the flow of the crowds in the area. Mr Richardson also stated that Mr Lewis had not provided a risk assessment or event management plan, and no evidence had been provided that a street trading licence had been granted. A copy of the objection was included as Appendix C - Noise Nuisance Objection.

Extracts from the council's statement of licensing policy were included as Appendix D - Carnival Policy. A map of the area was included as Appendix E - Map.

The sub-committee was asked to consider the objection notices and take such steps as it considers necessary for the promotion of the licensing objectives1. The steps available to the sub-committee were to:

  • Issue a counter notice if it considers it necessary for the promotion of any of the licensing objectives to do so,
  • Take no action, and allow the notice to have effect, or
  • If the premises has the benefit of a premises licence or club premises certificate impose one or more conditions which are specified on the premises licence or club premises certificate which the committee considers are not inconsistent with the carrying out of the licensable activities under the temporary event notice.
