The Licensing Act Committee met to discuss the Street Trading Review, and agreed to recommend a revised Street Trading Statement of Practices, Procedures and Policy to the council for approval, with some amendments. The committee also approved the minutes of previous meetings held in June and earlier in the summer.
Street Trading Review
The committee considered the report on the Street Trading Review, which sought feedback on the consultation and endorsement of the Licensing Service's comments, with a view to recommending a revised policy to the council.
Julie Flower, Principal Licensing Practitioner (Policy), presented the proposed changes.
The committee discussed:
- Clarification of the information given to applicants, stating that they need to obtain permission to use any Cornwall Council owned land, whether it be a beach or public open space.
- An additional paragraph to condition 3 of the policy, stating that a copy of the consent must be produced on demand to an authorised officer of Cornwall Council or a Police Officer.
During the debate, the following points were noted:
- A suggestion that the text be in bold print when advising those who have submitted Temporary Event Notices (TENs) that they need to obtain permission to use any CC owned land.
- A correction to a typo in the paragraph from Liskeard Town Council on page 16 of the report pack, changing
although glow sticks are plastic and singe use
toalthough glow sticks are plastic and single use
. - A suggestion that the following paragraph be in bold text (page 27 of the report):
Failure to gain permission from the relevant service potentially creates offences under the Local Government (Miscellaneous Provisions) Act 1982 for trading without a Consent.
The committee thanked Julie Flower, Principal Licensing Practitioner (Policy), for her work on the review.
The committee agreed to:
- Note the responses received in respect of the consultation.
- Endorse the comments made by the Licensing Service in relation to the consultation response.
The committee agreed to recommend to council that the revised policy be approved with the following amendments:
- An additional paragraph be added to condition 3 of the policy as follows:
Further, a copy of the Consent must be produced on demand to an authorised officer of Cornwall Council or a Police Officer.
- That bold text be used in the sentence advising those who have submitted Temporary Event Notices that they need to obtain permission to use any CC owned land.
- The sentence in the paragraph from Liskeard Town Council (Page 16 of the report pack) be amended as follows:

The Local Government (Miscellaneous Provisions) Act 1982 allows local authorities to designate streets in their area as prohibited, licensed, or consent streets. Cornwall Council adopted the legislation on 16 February 2010, choosing to regulate street trading through a system of 'consent' and 'prohibited' streets. On 1 July 2016, the council designated the whole of Cornwall as a 'consent' area. The council's Street Trading Statement of Practices, Procedures and Policy sets out the council's approach to street trading, including the types of trading that are exempt from requiring a street trading consent. The revised policy includes updates on single use plastics, clarification on the disposal of business waste, and DBS checks1.
The consultation response database includes responses from town and parish councils, local members, street traders and other stakeholders, as well as all relevant Cornwall Council services and officers. The amended street trading policy includes the suggested amendments for consideration.
