Ellonies - The Square, Bishops Waltham

The sub-committee was scheduled to consider an application for a new premises licence for Ellonies, The Square, Bishops Waltham, Hampshire, SO32 1GS.

Ellonies Ltd applied for the licence, describing the premises as:

a bistro comprising multiple levels, including a ground floor, mezzanine, loft floor with proposed additional seating outside on the pavement at the front of the venue. Food and alcohol will be served throughout all area of the premises and pavement. The space is designed to accommodate both casual dining and drinks across all floors.

The applicant sought to provide licensable activities including the supply of alcohol, late night refreshment, live music and recorded music. The application was later amended to reduce the timings.

The report pack notes that representations were received from four 'Other Persons', but following amendments to the application, three withdrew their representations. The remaining representation came from two ward councillors, objecting to the application on the grounds of public safety and the prevention of public nuisance. The councillors consider that the conditions do not fully mitigate the harm caused from the use of the rooftop.

Objections

The representation from Councillors Jonathan Williams and Steve Miller, Winchester City Councillors for Bishop's Waltham & Durley, stated their objection to the licensing application, due to the inclusion of the outdoor rooftop area. The councillors raised concerns that the consumption of alcohol in this area would cause both a public nuisance and a public safety risk. The councillors stated:

The rooftop area of the application is at the same elevation (or above) of those residential properties nearby, where bedroom windows are overlooked/viewable and in close proximity. Noise associated with the consumption of alcohol in this outside rooftop location is where, because of the increased elevation, we believe there would be an enhanced impact of public nuisance to those residents. We also feel that there is an issue of public safety from the rooftop should there be the consumption of alcohol in this location.

The councillors stated that their public safety concern could be mitigated through enhancing the rooftop perimeter, but without any details of those mitigations being put forward, they maintained their objection.

Licensing Objectives and Conditions

The report pack stated that the sub-committee is obliged to determine the application with a view to promoting the licensing objectives¹. These are:

• The prevention of crime and disorder
• Public safety
• The prevention of public nuisance
• The protection of children from harm

The report pack also included possible conditions that the Sub-Committee may wish to consider if the application is granted, to reflect the Operating Schedule provided by Ellonies Ltd. These included:

• The hours the premises may be used for the sale of alcohol
• The hours the premises may be used for the provision of regulated entertainment
• The hours the premises may be used for the provision of late night refreshment
