  • That the development be carried out in accordance with the listed plans and drawings.

  • Surface water and foul sewage drainage works must be constructed in accordance with the Preliminary Drainage Strategy .
  • The development must be carried out in accordance with the submitted flood risk assessment.
  • No extensions shall be erected within the curtilage of any dwellinghouse on plots 11-14 forward of the south-facing rear elevation.
  • A scheme to minimise the impact of noise, vibration, dust, and dirt on nearby residential properties must be submitted and approved.
  • Working hours are restricted to between 07:30 and 18:00 Mondays to Fridays, and 07:30 to 13:00 on Saturdays, with no work on Sundays or bank holidays.
  • If piling is required, a schedule of works to mitigate noise, dust, and vibration must be submitted and approved.
  • Any unexpected land contamination must be reported immediately to the local planning authority.
  • A Construction Environmental Management Plan (CEMP) must be submitted and approved.
  • The access to the site must be set out and constructed according to the Local Highway Authority's specifications.
  • Detailed engineering drawings of all aspects of roads and sewers must be submitted and approved.
  • The carriageway and any footway or footpath must be constructed to binder course macadam level or block paved and kerbed, with street lighting installed and operational before any part of the development is brought into use.
  • A Construction Management Plan must be submitted and approved.
  • The development must be carried out in accordance with the submitted Preliminary Ecological Appraisal and Preliminary Roost Assessment mitigation.
  • A Landscape and Ecological Management Plan (LEMP) must be submitted and approved.
  • The approved landscape scheme for soft works must be implemented within six months of the practical completion of the development.
  • Root protection area (RPA) fencing must be implemented and maintained around trees to be retained.
  • Details of the materials to be used in the construction of the exterior walls and roof must be submitted and approved.
  • The first-floor windows in the side elevations of plots 14, 15, 18, and 19 shall be glazed with obscure glass.

The Section 106 legal agreement includes the following terms:

  • 20% of the total number of units (4 dwellings) will be affordable housing units (4 x 3 bed), with a tenure of 2 for social rent and 2 for shared ownership.
  • An off-site contribution will be made towards recreational open space, as per the Selby District Developer Contributions SPD.
  • On- and off-site ecology-led landscaping will be implemented, including a management plan for 30 years.
  • A monitoring contribution of £2,522.00 will be made.
  • A waste and recycling contribution of £65 per dwelling will be made, totaling £1300.00, prior to the occupation of the first dwelling.
