The sub-committee was advised that, having considered the review application and submissions from all parties, if it believed that the operation of the premises was likely to undermine any of the four licensing objectives, and this could not be resolved through the imposition of conditions, the Premises Licence should be revoked.

  • exclude a licensable activity from the scope of the licence

The Rum Sailor Premises Licence Application

The sub-committee was scheduled to consider an application for a new premises licence for The Rum Sailor, Prow Park, Treloggan Industrial Estate, Newquay, TR7 2SX. The applicant, Edward Ashley Potter, requested permission to conduct the following licensable activities:

  • Films - Both Indoors and Outdoors > We may introduce cinema/film screenings, particularly for families during the school holidays. The screenings may be outdoors or indoors, allowing families to watch films whilst enjoying food and drink provided by small local businesses.
  • Anything of a similar description to that falling within (e: Live Music), (f: Recorded Music) or (g: Performance of Dance) – Both Indoors and Outdoors > We would like to host events such as live comedians, as well as talks and presentations from people of interest. We would also like to host local markets such as farmers markets and arts and crafts markets.
  • Supply of alcohol – Both on and off the premises

Newquay Town Council made a representation regarding the application, citing concerns about the prevention of crime and disorder and the prevention of public nuisance. In response, Mr Potter stated that the Rum Sailor would be happy to remove the possible provision of films from the application, and that all residents of the Dry Dock Apartments were made fully aware of the Rum Sailor (and the wider site) prior to undertaking the undertaking the shorthold lease.

Following a representation from the Environmental Protection Officer, Mr Potter agreed to include additional conditions on the Premises Licence relating to noise levels during outdoor screenings and the handling of items such as kegs and bottles.

The sub-committee was advised that it could grant the application in the terms sought, grant the application subject to additional conditions, grant the application but modify conditions, grant the application subject to restrictions, or reject the application.
