The Licensing Act Sub Committee of Cornwall Council met on Wednesday, 17 September 2025, to consider a premises licence review for the Boardmasters Festival and an application for a new premises licence for The Rum Sailor. The Sub-Committee was scheduled to determine whether to take action regarding the Boardmasters Festival's existing licence, and whether to grant a new licence to The Rum Sailor, with or without additional conditions.

Boardmasters Festival Licence Review

The sub-committee was scheduled to consider an application to review the premises licence for the Boardmasters Festival, Trebelsue Farm, Newquay, TR8 4AN, following an application from Andrea Lovett, an 'Other Person'.

The review application cited all four licensing objectives:

• Prevention of Crime and Disorder
• Public Safety
• Prevention of Public Nuisance
• The Protection of Children from Harm

The application to review the licence was based on the inclusion of the musical act Bob Vylan in the Boardmasters Festival 2025 line-up.

Representations regarding the review application were received from:

• Devon and Cornwall Police > Devon and Cornwall Police have been in discussion with the event organisers in respect of the performance of Bob Vylan. At this time, Devon and Cornwall Police are satisfied with the measures being put in place by Vision 9 to ensure that the licensing objectives are upheld in respect of the performance at this year's Boardmasters Festival. This decision is being monitored and regularly reviewed.
• Four other persons, including Derrick Waters, Jane Doheney, Estelle Morris and Simon Mould, who supported the review application because of concerns about Bob Vylan performing at Boardmasters.
• Three other persons, including Kuldeep Colt Uppal, Mohammed Zaman and Julian Fairclough, who made representations in support of Bob Vylan performing at the festival.

The report pack included the current premises licence, the approved premises plan, the review application, the public notice, and the representations received.

The sub-committee was advised that, having considered the review application and submissions from all parties, if it believed that the operation of the premises was likely to undermine any of the four licensing objectives, and this could not be resolved through the imposition of conditions, the Premises Licence should be revoked.

The available options listed in the Boardmasters Review Report were:

• modify the conditions of the premises licence
• exclude a licensable activity from the scope of the licence
• remove the designated premises supervisor
• suspend the licence for a period not exceeding three months
• revoke the licence

The Rum Sailor Premises Licence Application

The sub-committee was scheduled to consider an application for a new premises licence for The Rum Sailor, Prow Park, Treloggan Industrial Estate, Newquay, TR7 2SX. The applicant, Edward Ashley Potter, requested permission to conduct the following licensable activities:

• Films - Both Indoors and Outdoors > We may introduce cinema/film screenings, particularly for families during the school holidays. The screenings may be outdoors or indoors, allowing families to watch films whilst enjoying food and drink provided by small local businesses.
• Anything of a similar description to that falling within (e: Live Music), (f: Recorded Music) or (g: Performance of Dance) – Both Indoors and Outdoors > We would like to host events such as live comedians, as well as talks and presentations from people of interest. We would also like to host local markets such as farmers markets and arts and crafts markets.
• Supply of alcohol – Both on and off the premises

Newquay Town Council made a representation regarding the application, citing concerns about the prevention of crime and disorder and the prevention of public nuisance. In response, Mr Potter stated that the Rum Sailor would be happy to remove the possible provision of films from the application, and that all residents of the Dry Dock Apartments were made fully aware of the Rum Sailor (and the wider site) prior to undertaking the undertaking the shorthold lease.

Following a representation from the Environmental Protection Officer, Mr Potter agreed to include additional conditions on the Premises Licence relating to noise levels during outdoor screenings and the handling of items such as kegs and bottles.

The sub-committee was advised that it could grant the application in the terms sought, grant the application subject to additional conditions, grant the application but modify conditions, grant the application subject to restrictions, or reject the application.
