Summary

The Licensing Sub Committee E of Hackney Council scheduled a meeting to address licensing concerns within the borough. The agenda included a new premises licence application, a request to vary an existing premises licence and a personal licence application. Councillor Richard Lufkin, Councillor Lynne Troughton and Councillor Gilbert Smyth were scheduled to be in attendance.

Mango Biche Twist, 87 Kingsland High Street

Mango Biche Twist Dalston Limited submitted an application for a new premises licence for 87 Kingsland High Street, London, E8 2PB. The council was asked to consider authorising the sale of alcohol, as well as live and recorded music, from Monday to Sunday.

The applicant sought permission for the following:

  • Supply of alcohol (on and off-sales): Monday to Sunday 9:00 to 23:00, with non-standard hours on Christmas Eve and New Year's Eve.
  • Live music: Monday to Sunday 12:00 to 23:00, with non-standard hours on Christmas Eve and New Year's Eve.
  • Recorded music: Monday to Sunday 9:00 to 23:00, with non-standard hours on Christmas Eve and New Year's Eve.
  • Opening hours: Monday to Sunday 9:00 to 23:00, with non-standard hours on Christmas Eve and New Year's Eve.

The report pack noted that the premises did not currently hold a licence for any activity, and that no temporary event notices1 had been issued for the premises this year.

The council received one representation from local residents, raising concerns about:

  • Prevention of crime and disorder
  • Public safety
  • Prevention of public nuisance
  • Protection of children from harm

The council's Environmental Health Authority (Environmental Enforcement) initially made a representation, but withdrew it after agreeing conditions with the applicant.

The report pack included a number of conditions, derived from the applicant's operating schedule2 and agreed with the Environmental Enforcement, that could be added to the licence should it be granted. These included:

  • Maintaining a CCTV system
  • Keeping an incident log
  • Providing induction training to staff members engaged in selling alcohol
  • Displaying signage asking customers to leave quietly and respect local residents
  • Implementing a Challenge 25 policy3
  • Restricting the supply of alcohol to seated customers only
  • Limiting the number of people smoking outside to five at any one time
  • Limiting the number of customers seated in the external area to 10
  • Ceasing the use of the external area by 22:00

The report pack also included conditions relating to waste disposal, such as ensuring that the licensee has an appropriate contract for waste disposal, and that staff make regular checks of the area outside the premises to remove any litter.

The report pack outlined that the Licensing Sub-Committee could either refuse the application, or approve it with conditions or restrictions.

A letter from a local resident was included in the report pack, in which they stated:

Yet another licenced premises selling alcohol in a locality already over-saturated with such premises will add to the cumulative impact.

Nancy Spains, 128 Curtain Road

Curtain Road Limited applied to vary the premises licence for Nancy Spains, 128 Curtain Road, London, EC2A 3AQ. The premises is located in the Shoreditch Special Policy Area4.

The applicant sought permission to:

  • Include hours for supply of alcohol (off-sales) on Monday to Sunday.
  • Extend the terminal hours for sale of alcohol (on-sales), recorded music and live music on Wednesday and Thursday.

Specifically, the applicant requested the following:

  • Live music: Wednesday 23:00-1:00, Thursday 23:00-2:00
  • Recorded music: Wednesday 16:00-1:00, Thursday 16:00-2:00
  • Supply of alcohol (on-sales): Wednesday 8:00-1:00, Thursday 8:00-2:00
  • Supply of alcohol (off-sales): Monday to Sunday 12:00-21:00
  • Opening hours: Monday 8:00-0:30, Tuesday 8:00-0:30, Wednesday 8:00-1:30, Thursday 8:00-2:30, Friday 8:00-2:30, Saturday 8:00-2:30, Sunday 8:00-0:30

The report pack noted that the current premises licence was granted on 5 August 2024. It also noted that temporary event notices had been given for the premises on 9-10 February 2025 and 24-25 August 2025.

The council received representations from the police and one local resident. The police raised concerns about the prevention of crime and disorder and the prevention of public nuisance. The local resident raised concerns about the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm.

The report pack included a letter from Nicholas O'Halloran, responding to the representation from the local resident. In the letter, Mr O'Halloran stated that he could agree to a condition whereby the windows would be closed by 20:00 every night, and that he would agree to a condition to include Security Industry Authority (SIA) door staff on Wednesdays. He also stated that both the SIA door staff and bar team would be trained to routinely monitor the designated area for off-sales and ensure no litter is present.

The police asked that a condition be added to the licence stating that all off-sales of alcohol for consumption immediately outside the premises are only done so in a designated area, and that this area should be clearly defined.

The report pack outlined that the Licensing Sub-Committee could either refuse the application, or approve it with conditions or restrictions.

Personal Licence Application

The Licensing Sub-Committee was scheduled to consider an application for a personal licence. The report pack included a recommendation that the press and public be excluded from the meeting during the consideration of this agenda item due to the disclosure of exempt information as defined under paragraph 1, Part 1, Schedule 12A of the Local Government Act 19725.

The report pack noted that Hackney's Statement of Licensing Policy applies to the application, and that policy LP9 (Personal Licence) is relevant to the representation made.

The police objected to the application. A Licensing Officer stated that members should consider LP9 when determining the application.

The report pack outlined that the Licensing Sub-Committee could either reject the application if members consider it necessary for the promotion of the crime prevention objective, or grant the application.
