Summary

The Licensing Sub-Committee, consisting of Councillor Dhruv Tomar, Councillor Balwinder S Dhillon and Councillor Dilbagh S. Parmar, is scheduled to convene to address licensing matters, excluding those related to the Licensing Act 20031 and Gambling Act 20052. The committee will consider an application for a street trading grant, and private hire driver applications. Part of the meeting may be held in private due to the discussion of exempt information relating to individuals.

Street Trading Grant Application - FitMunch

The sub-committee is scheduled to review a street trading consent grant application from Wael Berhan for FitMunch, located in the Matalan car park, 217a Bath Road, SL1 4AA in Cippenham Village. Mr Berhan is seeking permission to sell fast food, sandwiches, and fizzy drinks from an orange food trailer. The proposed hours of operation are:

  • Monday - Friday: 09:00 to 20:00
  • Saturday: 09:00 to 19:00
  • Sunday: 11:00 to 17:00

According to the report pack, a street trading consent has never been issued for the proposed location in the Matalan car park. However, there is a street trading consent in force for a business located directly outside the Matalan car park, on Bath Road.

As part of the application process, Slough Borough Council consulted with various parties, including:

  • Thames Valley Police
  • Royal Berkshire Fire and Rescue Service
  • Ward Members
  • Slough Borough Council Planning
  • Slough Borough Council Highways
  • Slough Borough Council Transport
  • Slough Borough Council Trading Standards
  • Slough Borough Council Parking and Development
  • Slough Borough Council Food and Safety Team
  • Slough Borough Council Neighbourhood Enforcement Team
  • Owners or occupiers of properties within 100 meters of the proposed site

Following the consultation, the council received two objections, two responses of no objection, and one enquiry/comment. The objections raised concerns about:

  • Increased littering and loitering
  • Safety concerns from congestion due to additional traffic and lack of parking
  • The area becoming further unsightly and problematic

Thames Valley Police and Slough Borough Council Food and Safety Team have raised no objections to the application.

The sub-committee is able to grant the application with or without additional conditions, or refuse it. According to the report pack, the licensing team is unable to overturn any decision made by the Licensing Sub Committee.

Private Hire Driver Applications

The sub-committee will also consider private hire driver applications. Due to the confidential nature of these discussions, the press and public may be excluded from this part of the meeting.

Guidance on Predetermination/Predisposition

The sub-committee will note guidance on predetermination/predisposition. According to the report pack, predisposition is lawful, and members may have strong views on a proposed decision, and may have expressed those views in public, and still participate in a decision, so long as they maintain an open mind. Pre-determination and bias are unlawful and can make a decision unlawful.
