This meeting of the Licensing Sub-Committee of Wyre Borough Council was scheduled to discuss an objection from Lancashire Police to a temporary event notice (TEN) regarding licensable activities at The Cube, 2 Breck Road, Poulton-le-Fylde. The report pack included a recommendation to determine the temporary event notice in accordance with the Licensing Act 2003, Wyre Council Statement of Licensing Policy 2021-2026 and the Home Office Guidance issued under Section 182 Licensing Act 2003.
Objection to a Temporary Event Notice
The Licensing Sub-Committee was scheduled to review a report from Mark Billington, Director of Environment, regarding an objection to a temporary event notice (TEN) submitted by Ms Danielle Mellor of The Cube, 2 Breck Road, Poulton-le-Fylde.
Ms Mellor had submitted the TEN (number TEN000748) on 10 September 2025, seeking permission for regulated entertainment and the sale of alcohol between 02:00 and 03:00 on 28 September 2025. This would provide a one-hour extension to the timings authorised by the premises licence PL(A)0342.
PS Nat Cox of Lancashire Police had objected to the notice, asserting that the proposed events would undermine the licensing objectives of Prevention of crime and disorder and Public safety.
The report pack included copies of:
- The premises licence PL(A)0342 (Appendix 1 - Copy of PLA0342)
- The temporary event notice TEN000748 (Appendix 2 - Copy of countersigned TEN000748)
- The police objection notice (Appendix 3 Copy of Police Objection Notice)
The Licensing Sub-Committee was asked to consider the notice in accordance with the Licensing Act 20031, Wyre Council's Statement of Licensing Policy 2021-2026, and the Home Office Guidance issued under Section 182 Licensing Act 2003.
The report pack noted that a Temporary Event Notice is a notification that licensable activities are going to take place, and that the limit on numbers at such an event is 499. It also noted that the police can modify the notices by making changes to them, with the agreement of the premises user.
The report pack stated that the Licensing Committee could decide to:
- Allow the licensable activities to go ahead as stated in the Notice; or
- Impose one or more of the existing licence conditions on the TEN if it considers that this is appropriate for the promotion of the licensing objectives; or
- Decide that the event would undermine the licensing objectives and should not take place and issue a Counter Notice to the TEN.
