Summary

The Licensing Committee - Group 1 of Chesterfield Council were scheduled to meet to consider an application for a new premises licence. The application was for Sup it and See, located at 36 St Marys Gate, Chesterfield. A report pack was prepared for the meeting.

New Premises Licence Application: Sup it and See, 36 St Marys Gate

The committee were scheduled to consider a new premises licence application made by Anya Porter for Sup it and See, 36 St Marys Gate, Chesterfield.

The applicant, Anya Porter, sought a licence for the sale and supply of alcohol on and off the premises between 10:00 am and 3:00 am daily. The application also included regulated entertainment, specifically dance, live and recorded music, between 10:00 am and 3:00 am daily, with outdoor music ceasing at 12:00 am.

According to the Public Reports Pack, the application was accepted by the Licensing Department on 31 July 2025. As part of the process, notices were placed in the local press, at the premises, and on the Chesterfield Borough Council website. The Derbyshire Times published the notice on 21 August 2025.

The report pack noted that representations about the licence had been received.

A relevant representation has been made in respect of the application and not withdrawn. The application cannot be granted under officer delegated authority.

The report stated that Derbyshire Constabulary negotiated with the applicant to amend the hours of all activities to:

  • Sunday to Thursday: 11:00 am to 1:00 am
  • Friday and Saturday: 11:00 am to 3:00 am

In addition, the applicant agreed to conditions covering door supervision, proof of age, incident logs, drugs, and CCTV.

One representation from a nearby resident, Luke Shah of Huckleberry Willow, was received and accepted on 23 August 2025. A further representation was received on 3 September 2025 from Louise Helen Finney of Chandlers Bar.

The representations raised the following issues:

Prevention of Crime and Disorder

  • Cigarette butts being thrown and causing damage.
  • An incident of a brick being thrown causing damage, related to the previous owner.

Prevention of Public Nuisance

  • Music nuisance to customers from the use of the outdoor space, overall volume of music played at the venue and terminal hour of this activity.
  • Increased noise and disturbance from users of the venue, and activities taking place from within.

General Concerns

  • Possible invasion of privacy from customers looking into the representors outdoor space.

The report pack included a table comparing nearby licensed venues' activity hours:

The Licensing Officer, Glenn Holden, recommended that the committee consider the details and impact of the new premises licence application and the concerns identified in the representation received, and determine whether the application be granted, granted with modification, or refused.

A supplementary agenda pack included further information from Louise Helen Finney of Chandlers Bar, stating that she had spoken to Anya Porter and that Anya Porter had been actively trying to keep the noise level to a minimum. Louise Helen Finney stated that as long as her concerns were kept in mind while the venue was operational, and the venue continued to run with its noise levels as they were at the time of writing, then she was happy for everything to go ahead as planned, and that she would not be attending the meeting.
