The Licensing Sub-Committee of Kensington and Chelsea Council were scheduled to convene to consider an application by Grandio Group UK and Europe Limited for a new premises licence for 201-207 Kensington High Street to operate as a brasserie sportive
. The committee was to consider representations for and against the application, and determine whether to grant the licence, modify the proposed conditions, or reject the application.
Application for New Premises Licence
The Sub-Committee were scheduled to review an application by Grandio Group UK and Europe Limited for a new premises licence for 201-207 Kensington High Street, London, W8 6BA. The applicant sought permission to conduct the following licensable activities:
- Exhibition of Films (Indoors): Monday to Sunday, 9am to 11:30pm
- Late-Night Refreshment (Indoors): Monday to Sunday, 11pm to midnight
- Sale by Retail of Alcohol (On the Premises): Monday to Sunday, 9am to 11:30pm
- Opening Hours: Monday to Sunday, 9am to midnight
The applicant stated that the premises, spanning ground, mezzanine, and basement floors, would operate as a brasserie sportive
with approximately 250 covers.
As part of the application, Grandio Group UK and Europe Limited proposed steps to promote the licensing objectives1, including:
These include effective odour control; customer notices encouraging quiet departure; a comprehensive CCTV system with trained operators; maintenance of an incident log; provision of a dedicated complaints contact; restrictions on deliveries, refuse disposal and collections; a requirement for alcohol sales to be ancillary to substantial meals except in clearly defined circumstances; and the adoption of a Dispersal and External Management Plan in consultation with RBKC and the Metropolitan Police.
The report pack notes that during the consultation period, the applicant agreed with RBKC Trading Standards to implement a 'Challenge 25' policy2 and display notices indicating this policy was in operation.
Three representations opposing the application were received, primarily citing concerns regarding potential public nuisance due to noise, litter, and the unsuitability of a late-night venue in a mixed-use area. One representation supporting the application was received, stating that the proposal would enhance the character and vitality of the local area, and that the application included a comprehensive set of proposed conditions addressing noise, nuisance, safety and public order. Correspondence from David Inzani, Partner at Poppleston Allen, Solicitors acting for Grandio Group UK & Europe Limited, was included in the report pack. This included correspondence to those who had made representations, and set out a number of safeguards that the applicant believed would directly address the issues raised.
The Sub-Committee were advised to consider the Secretary of State's Guidance and the council's Statement of Licensing Policy, and that they must act with a view to promoting the licensing objectives: the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm.
