The Licensing Act Sub Committee of Wirral Council met on 19 September 2025 to consider an application for a premises licence. Councillor Cherry Povall, JP, Chair of Regulatory and General Purposes Committee, was scheduled to chair the meeting. Councillors were asked to declare any interests relating to the application.
Application for a Premises Licence - Garage Number 5, Heathbank Road, Birkenhead, CH42 7LD
The sub-committee was scheduled to consider an application for a premises licence relating to Garage Number 5, Heathbank Road, Birkenhead. The application was made by Manchester Beer Bike Limited.
The report pack stated that the sub-committee was required to determine the application, because relevant representations had been received.
The licence application was for:
Sale by Retail of Alcohol for consumption Off the premises Sunday to Saturday 08:00 to 21:00
Hours Open to the Public
Sunday to Saturday 08:00 to 21:00
However, the applicant stated that customers would not be permitted access to the garage, and that the premises would only be used to store alcohol that would be appropriated to any sale of alcohol following the confirmation of a contractual order.
The report pack noted that applicants are required to submit an operating schedule that sets out how they will manage their business to promote the four licensing objectives1. It also noted that the proposals set out in the operating schedule may become conditions of the licence if the application is granted.
Representations against the application had been received from 13 local residents, as well as a petition containing 33 signatures. The representations and petition related to concerns regarding potential anti-social behaviour and public nuisance.
The report pack stated that no representations had been received from any of the responsible authorities2.
The report pack stated that under the Licensing Act 2003, the Licensing Authority must carry out its functions with a view to promoting the licensing objectives which are:
- the prevention of crime and disorder;
- public safety;
- the prevention of public nuisance; and
- the protection of children from harm.
The report pack also noted that the Licensing Authority must have regard to its licensing statement published under section 5 of the Licensing Act 2003, and any guidance issued by the Secretary of State under section 182 of the Licensing Act 2003.
