The Licensing Act Sub-Committee of Wirral Council is scheduled to meet to consider an application for a new premises licence. The meeting will also cover standard agenda items, such as the appointment of a chair and declarations of interest from members.
Application for Premises Licence - Premier, Prenton Road West, Birkenhead
The sub-committee is scheduled to consider an application for a premises licence for a business to be known as Premier, located at 4-8 Prenton Road West, Birkenhead. The applicant, Baskaran Sinnathurai, has applied for a licence to sell alcohol for consumption off the premises between the hours of 07:00 and 23:00, Sunday to Saturday.
According to the Public Reports Pack, the Licensing Authority received objections from local residents, and a representation from the Devonshire Park Residents Association. These representations relate to concerns about potential anti-social behaviour and public nuisance if the application is granted.
The report pack states that the applicant initially requested to sell alcohol and remain open until 02:00, but later reduced the requested hours to 23:00 after the representations were received. The applicant also withdrew a request for late night refreshment until 02:00.
The report pack states that following discussions with Environmental Health, the applicant has agreed to the following conditions being attached to the Premises Licence, should the application be granted:
- No nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises.
- There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly.
- Waste must not be disposed of from the premises into outside waste containers between the hours of 21:00 and 09:00.
The report from Richard Leyland, Licensing Team Leader, notes that the Licensing Act Sub-Committee must consider Wirral Council's Statement of Licensing Policy, any guidance issued by the Secretary of State under Section 182 of the Licensing Act 20031, and the four licensing objectives outlined in the Licensing Act 2003:
- the prevention of crime and disorder
- public safety
- the prevention of public nuisance
- the protection of children from harm
The report also notes that the sub-committee must have regard to the Equality Act 2010 and in particular the Public Sector Equality Duty under Section 149 of the Equality Act 2010 when determining the matter.
