The Miscellaneous Licensing Committee met to discuss several applications for Hackney Carriage and Private Hire Vehicle Driver's Licences, ultimately granting one, granting one subject to conditions, and refusing three. Licensing Applications
The committee considered several applications for Hackney Carriage and Private Hire Vehicle Driver's Licences under the Town Police Clauses Act 1847 and the Local Government (Miscellaneous Provisions) Act 1976. Each applicant was given the opportunity to speak in support of their application and answer questions from the committee.
Application for Grant of Licence - E1D216
The committee refused the application for the grant of a Hackney Carriage and Private Hire Vehicle Driver's Licence for applicant E1D216, as they did not consider them to be a fit and proper person to hold such a licence. The decision was based on the report presented, the response from HR Safeguarding, and the applicant's statements during the meeting. The committee felt that the offences were serious and impacted public safety, and it was not appropriate to depart from the guidelines in this specific case. The committee stated that they would not allow a person for whom they care to travel alone in a vehicle driven by E1D216 at any time of day or night.
Application for Renewal of Licence - E1D217
The committee refused the application for the renewal of a Hackney Carriage and Private Hire Vehicle Driver's Licence for applicant E1D217, as they did not consider the applicant to be a fit and proper person to be granted the renewal of their licence. The committee heard that E1D217 accepted responsibility for not notifying licensing of driving endorsements. The committee noted that E1D217 had a total of 9 points on their driving licence for speeding, incurred within a one-month period, and had previously undertaken a speed awareness course. The committee was concerned that this showed a pattern of behaviour, and that E1D217 had failed to notify the council of the endorsements, despite it being a condition of their licence to do so. The committee stated that they would not allow a person for whom they care to travel alone in a vehicle driven by E1D217 at any time of day or night.
Application for Grant of Licence - E1D215
The committee granted the application for the Grant of the Hackney Carriage and Private Hire Vehicle Driver's Licence for Applicant E1D215, subject to the applicant providing written confirmation from the Driver and Vehicle Licensing Agency (DVLA) that they have been notified of the medication she is currently taking. The committee was satisfied that the applicant met the DVLA Group 2 Medical Standards, but requested the confirmation due to the medication E1D215 was taking.
Review of Licence - E1D194 and Vehicle Licence EV17
The committee considered reports regarding the review of Hackney Carriage (Caradon, North Cornwall, and Restormel Zones) and Private Hire Vehicle Driver's Licence E1D194, and Hackney Carriage Vehicle Licence EV17. The committee decided to take no action in respect of either licence. Members heard from both licence holders, as well as another licensed driver who spoke in support of them. The committee noted that there was insufficient evidence to take any action regarding the allegations made.
Exclusion of Press and Public
The committee resolved to exclude the press and public from the meeting during consideration of the licensing applications. This decision was made in accordance with the Local Government Act 1972, as the discussion was likely to involve the disclosure of exempt information relating to individuals.
