Determination of Continued Entitlement of a Hackney Carriage and Private Hire Vehicle Driver's Licence

The Sub-Committee was scheduled to consider two reports, Appendix B and Appendix C, both submitted by the Director of Neighbourhood and Environmental Services. These reports concerned the determination of the continued entitlement of individuals to hold a Hackney Carriage and Private Hire Vehicle Driver's Licence.

Appendix B was restricted under paragraphs 1, 2, and 3 of Part 1 of Schedule 12A of the Local Government Act 1972. These paragraphs relate to information concerning any individual, information likely to reveal an individual's identity, and information relating to the financial or business affairs of any particular person.

Appendix C was also restricted, under paragraphs 1, 2, 3, and 7 of Part 1 of Schedule 12A of the Local Government Act 1972. In addition to the restrictions for Appendix B, this also included information relating to any action taken or to be taken in connection with the prevention, investigation, or prosecution of crime.

The agenda indicated that these reports would be considered in a private session, with the press and public excluded. This was recommended on the grounds that the reports contained 'exempt' information, and that the public interest in maintaining the exemption outweighed the public interest in disclosure. The Sub-Committee was to pass a resolution to this effect, in accordance with Section 100A(4) of the Local Government Act 1972.

The procedural guide for the Licensing Sub-Committee outlines that in such cases, after the presentation of reports and any questions for clarification, parties would sum up their positions. The Legal Adviser would then advise the Sub-Committee on relevant issues before members deliberated in private to make their decision. The applicant would be informed that the decision would be made public within five working days.

The minutes of the previous meeting, held on 16 December 2025, were also scheduled for confirmation. In that meeting, one driver was allowed to retain their licence with a warning, while another application was adjourned to the 27 January 2026 meeting.
