The primary item scheduled for discussion was an application by Just Cravings Ltd to vary their premises licence. The company sought to remove Condition 19, which currently states:

No customers shall be allowed into the venue or collect any products from the venue from 00.00 hours (midnight): Sunday-Thursday. Any orders from 00.00hrs (midnight) to 01.45am on Sunday-Thursday shall be by delivery service only.

This condition was originally imposed by the Licensing Committee on 23 April 2025, following representations from local residents concerned about anti-social behaviour, noise, and littering. The current application aims to allow customers to enter the premises and collect orders on-site between midnight and 1:45 am from Sunday to Thursday, instead of being restricted to delivery services during these hours.

The report pack indicated that representations had been received from the Licensing Officer, supported by Councillor Anthony Molloy, a local councillor for Kilburn. The Licensing Officer's representation noted that while no relevant complaints had been received since the licence was granted, they did not agree with the full removal of the condition. As a compromise, the Licensing Authority suggested that the condition be disapplied only for the duration of Ramadan, with the existing restriction remaining in force at all other times of the year. The applicant, represented by Mustafa Ahmed, Managing Director of Just Cravings Ltd, had previously indicated a willingness to accept this compromise as a trial period, with a view to permanently lifting the restriction after Ramadan if no complaints arose. However, subsequent correspondence indicated a disagreement on the terms of this compromise, leading to the matter being referred to the committee for a hearing.

The report pack also included the original decision notice from 23 April 2025, detailing the reasons for the imposition of Condition 19, which included concerns about noise and littering, particularly during certain religious periods. The applicant had argued that since the licence was granted, there had been no restrictions on Fridays and Saturdays, and no complaints had been received regarding noise or anti-social behaviour during later trading hours on those days, suggesting their ability to manage later trading responsibly. They also highlighted that no objections or complaints were made against the current variation application during the consultation period.
