Unreasonable Complainant Behaviour Policy Update

The report provides an updated Unreasonable Complainant Behaviour policy and proposes a centrally managed process for the very small occasions when the Council implements this policy. The Council’s complaints policy explains how customers can make a complaint and the procedure that will be followed. A consistent approach to handling complaints came into effect on 01 April 2024 in line with the obligation on the Council to follow a two-stage process set out in the Housing Ombudsman Code of Complaint Handling, mirrored in the Local Government and Social Care Ombudsman’s draft Complaint Handling Code. Whilst the Council is committed to dealing with all complaints fairly, on occasion, our employees have to deal with unreasonable, persistent or vexatious behaviour from customers. On these, fortunately rare, occasions this behaviour can take up a lot of officer time. The LGSCO provides guidance to help authorities and other bodies within their jurisdiction to develop a proportionate approach when responding to unreasonable complaint behaviour, based on their view of good practice in dealing with these customers. The Council’s updated policy is presented for approval. Changes include the introduction of a managed approach when considering applying this policy and to managing the process for review after it has been applied.

Local Government Reorganisation: Interim Submission to Government

To enable Fareham Borough Council to meet the timescales set by the Government for the submission of an interim position statement as plans are developed for local Government Reorganisation across Hampshire and the Solent area. The Government has selected Hampshire and the Isle of Wight, and all Councils in the area including Fareham Borough Council, to be part of its Devolution Priority Programme (DPP). A requirement of the DPP is that the district, county and neighbouring unitary councils should merge with neighbouring authorities to form larger unitary councils (also known as local government reorganisation or LGR). The Secretary of State has formally requested that interim LGR proposals are made by 21 March 2025, with final business cases to be submitted by 26 September 2025. Following the final business case submission, Minister will decide their preferred option for LGR in Hampshire, and lay legislation in Parliament leading to the new councils taking legal effect from 1 April 2028 at the latest. The report presents the draft interim plan that has been developed in collaboration with all Councils across Hampshire/IoW and seeks the approval of the Executive to submit it to Government by 21 March. The Executive is also asked to endorse the progression of the work, under the direction of the Executive Leader and Chief Executive Officer, in order to develop a final business case for Full Council consideration later in 2025.

Application to list Stubbington Study Centre as an Asset of Community Value

To assess the nomination to register Stubbington Study Centre as an Asset of Community Value. Hampshire County Council (HCC) owns the Stubbington Study Centre and has recently consulted on a proposal to close the Study Centre and relocate a Secure Children’s hone to this site. On the 6 February 2025, Hill Head Residents’ Association (HHRA) submitted an Asset of Community Value (ACV) nomination form to Fareham Borough Council, asking that Stubbington Study Centre be registered as an ACV. There is a strict set of legal conditions that a nomination needs to demonstrate for an asset to qualify as an ACV. If it qualifies, the Council must register it by the deadline of 3 April 2025 (8 weeks from receipt of valid nomination). Registration of Stubbington Study Centre as an ACV would prevent HCC from selling the asset, for up to 5 years, without HHRA first being given the chance to bid for it. The listing of the Study Centre as an ACV would be a material planning consideration in any future planning application for development at the site. The report outlines the evidence submitted as part of the nomination and assesses it against the legal creiteria.

Warm Homes Social Housing Fund, Wave 3

To provide an overview of the Warm Homes Social Housing Fund, Wave 3 grant and seek Executive approval to undertake energy efficiency works under this scheme. The Warm Homes Social Housing Fund (WH) Wave 3 is a government initiative aimed at improving the energy efficiency of social housing across England. The scheme provides funding to social housing landlords to retrofit existing properties. The fund focuses on upgrading homes with an Energy Performance Certificate (EPC) below band C. The Council will be required to fund a minimum of 50% of the eligible project costs. These costs will be incorporated in the HRA capital programme within existing budgets for stock improvements over the next 3 financial years to ensure this funding opportunity can be utilised. A confidential appendix is included in the report and outlines the cost of the project. The procurement process is still in the early stages, therefore in the interest of fairness, best value and commercial sensitivity the full details are restricted. An application has been submitted for this project, following consultation with the Director of Housing and the Executive Member for Housing. Subject to funding being awarded, approval is sought to undertake the works and enter a contract with an appropriate supplier, through an approved framework. Approval is also sought for the funding arrangements to meet the Council’s contribution.

Local Authority Housing Fund Grant Funding

The report seeks Executive approval to purchase four homes, including three homes for temporary accommodation and one home for Afghan families using funding allocated through the Government’s Local Authority Housing Funding (LAHF). The purpose of LAHF is to support councils to obtain quality temporary accommodation for homeless families, and safe and suitable housing for Afghan citizens who are fleeing persecution. Fareham has been deemed an area with a need for this type of housing, therefore the government has awarded match funding to the council to enable it to acquire additional affordable homes for this purpose. The Director of Housing will utilise an existing delegation to sign a Memorandum of Understanding, detailing the funding arrangements with the Ministry of Housing, Communities & Local Government. Further details are included in the confidential appendix attached to the report. The Executive is asked to delegate the authority to approve property purchases to the Director of Housing, following consultation with the Executive Member for Housing.
