Purpose

Bingley Town Council have been preparing a
Neighbourhood Development Plan (NDP) for their area under the
provisions of the Localism Act 2011 and the Neighbourhood Planning
(General) Regulations 2012 (as amended) (the 2012 Regulations) to
help shape future growth and development of its community.
The Town Council (via its Neighbourhood Plan Steering Group),
together with assistance from a planning consultant and technical
support from Locality/AECOM, have been preparing the BNDP over the
last seven years. Extensive consultation has taken place with
residents as well as other individuals and bodies with an interest
in how the Bingley area develops. This included public consultation
and workshop events. A formal pre-submission consultation (under
Regulation 14 of the 2012 Regulations) was held during between 12th
February and 4th April 2024. This consultation period was organised
and managed by the Town Council. During the Plan’s
preparation officers within the Local Plan Team have provided
direct support to the Town Council throughout the process in the
form of technical advice, attending meetings and providing comments
and feedback on draft versions of documents and polices, include
formal comments during the consultation period.
In accordance with Regulation 15 of 2012 Regulations, the Town
Council have formally submitted the BDNP together with key
supporting documents to City of Bradford Metropolitan District
Council (CBMDC) to enable a formal consultation period required by
Regulation 16 of the 2012 Regulations.
CBMDC consider that the Plan has addressed the issues which have
arisen throughout the consultation processes and that the plan
meets the Basic Conditions as required under the Localism Act 2011.
As such the consultation should take place in a timely
manner.
Once the decision is made to undertake the consultation, the BNDP
and supporting documentation must be placed on the CBMDC website
and made available for public inspection at appropriate locations
within the neighbourhood area. CBMDC is also required to publicise
the consultation to bring it to the attention of the wider
community and stakeholders.
Following the end of the consultation period, all representations
will be recorded, collated, and submitted (together with the BNDP
and supporting documentation) to a suitably qualified and
experienced Examiner, who will conduct an independent examination
of the Plan. The Examiner will assess the BNDP to determine whether
it meets the Basic Conditions and other legislative
requirements.
If the BNDP passes examination, it may then proceed to a local
referendum. The decision to proceed to referendum will be taken by
CBMDC’s Executive committee. The referendum will be arranged
and conducted by CBMDC’s Electoral Services team.
If the Plan receives a majority vote in favour, the Council will
formally “make” (adopt) it in line with the agreed
neighbourhood planning governance process. Once “made”
(adopted) the BNDP will then become part of the statutory
development plan for Bradford District and ultimately used by
Development Management in the determination of planning
applications within the neighbourhood plan area.
