Resolved –
Having considered
all valid representations made by the parties at the hearing, the
written representations received during the review process, the
Council’s published Statement of Licensing Policy, the
Licensing Act 2003 (in particular sections 4 and 52 concerning the
promotion of the licensing objectives and the determination of a
review of a premises licence), and the relevant statutory guidance
issued under section 182 of the Licensing Act 2003, the Panel is
satisfied that the operation of the premises licence for Wisla, 50
Cavendish Street, Keighley, BD21 3RL has undermined the licensing
objectives.
The Panel had no
confidence in light of the evidence
heard, that the premises licence holder would be able to meet and
uphold one or more of the Licensing Objectives, in particular
Prevention of Crime and Disorder, Public Safety, Protection
Children from Harm. The available evidence provided insufficient
assurance that criminal offending would not be repeated. For these
reasons the Panel therefore revoke the licence.
