Resolved-
Having
considered all valid representations made by the parties at the
hearing, the written representations received during the
consultation period, the Council’s Statement of Licensing
Policy, the Licensing Act 2003 (in particular sections 4 and 18),
and the statutory guidance issued under section 182 of the
Licensing Act 2003, the Panel is satisfied that the application for
a premises licence for Burnt Bear is
granted subject to the following condition necessary for the
promotion of the licensing objectives.

A noise limiter shall be installed in
consultation with and to the satisfaction of the Environmental
Health department.
Reasons:
Members carefully considered the concerns raised by responsible
authorities and other persons regarding the potential impact of the
premises on the surrounding area.
The
Panel recognised the applicant’s intention to operate the
premises responsibly but concluded that additional safeguards were
required to promote the licensing objectives.
The
Panel considered that the condition to be appropriate and
proportionate in promoting the prevention of public nuisance
licensing objective while allowing the premises to
operate
