Resolved-
Having considered all
valid representations made by the parties at the hearing, the valid
written representations received during the statutory consultation
period, the Council’s published Statement of Licensing
Policy, the Licensing Act 2003 (in particular sections 37 and
42 concerning applications to vary a premises licence to
specify a designated premises supervisor and to transfer a premises
licence respectively), and the relevant statutory guidance
issued under section 182 of the Licensing Act 2003, the Panel
is satisfied that granting the applications to transfer the
premises licence and to vary the premises licence to specify the
applicant as the Designated Premises Supervisor for Jimmy’s, 97 Great Horton Road, Bradford,
BD7 1PS would undermine the licensing objectives, in particular
the prevention of crime and disorder.
Reasons:
Members have
carefully considered the representations and evidence before them,
including the history of criminal offending that led to the
revocation of the previous premises licence.
In the view of
the Panel, the available evidence provides insufficient
assurance Members therefore have no confidence that the criminal
offending would not be repeated.
The Panel finds
that the risk of recurrence of matters undermining
the prevention of crime and disorder objective is such that it
would be inappropriate to grant either the transfer of the premises
licence under section 42 of the Licensing Act 2003 or the variation
to specify the applicant as Designated Premises Supervisor under
section 37 of that Act.
For these reasons, the
Licensing Panel refuses the application to transfer the
premises licence and refuses the application to vary the premises
licence to specify the applicant as the Designated Premises
Supervisor.
