Purpose

This report proposes:

1.     Approving the policy for the enforcement of the Clean Air Act 1993 including setting the financial penalty for a breach of the London Borough of Camden Smoke Control Order 2025 at the maximum £300

2.     Delegation of authorisation to enforce the Smoke Control Order and the Clean Air Act 1993 to named officers within the Sustainability, Air Quality and Energy service.

The Camden Clean Air Action Plan 2023-2026 (CAAP) commits the Council to enforcement of the Clean Air Act 1993. The Cabinet decision in December 2022 to approve the CAAP delegated authority to the Executive Director Supporting Communities to implement and monitor the CAAP. For this reason, the approval requested in this report may be granted by the Executive Director as a non-key executive decision.

Decision

That the Executive Director Investment, Place and Opportunity, following consultation with the Cabinet Member for Planning and a Sustainable Camden:

  1. Approves the policy for the enforcement of the Clean Air Act 1993 and setting the financial penalty for emissions of smoke in Camden at £300 per breach of the London Borough of Camden Smoke Control Order 2025.
  2. Authorises the following officers to issue financial penalties under the Clean Air Act 1993:

Air Quality Programme Manager, Air Quality Policy and Project Officer,

Air Quality Projects Lead, Project Officer (Sustainability), Air Quality Technical Officer, Environmental Health Officer, Environmental Health Technician, Trading Standards Officer
