Purpose

This report sets out the decision on the removal of a tree subject to section 115 of Environment Act 2021, which requires the Council to consult the public on the removal of a healthy street tree.

The report seeks approval for removing the Sycamore opposite 7 St Martin’s Close which has been implicated in causing subsidence. There were 0 comments received during the 28-day consultation: 0 number of comments for and against. Failure to remove the tree will result in litigation against the council.

This report is coming to the Interim Head of Leisure because they are authorised to make decisions on felling public trees on the highway in accordance with section 115 of the Environment Act 2021. This is set out under the scheme of delegations by the Executive Director Investment, Place and Opportunity.

Decision

THAT the Interim Head of Leisure approves the removal of the sycamore tree opposite 7 St. Martin’s Close.
