Purpose

The purpose of this decision
and report for consideration is to recommend various proposed road
safety measures identified from the WSP Transport Report, and
engagement with the Kenley Community Action Group. The engagement
included site walkabouts with ward councillors and resident
representatives in February 2023.
 
 
The proposed measures are as
follows:
 
     
i.               
To reduce the current speed limit from 40 mph to 30
mph along Hayes Lane from a point 180 metres south of Old Lodge
Lane junction to the borough boundary with Surrey County Council by
a Speed Limit Order under the Road Traffic Regulation Act 1984 (as
amended).
 
    
ii.               
To introduce traffic calming measures in the form of
flat-topped road humps along the section of Hayes Lane between its
junction with Park Road and Firs Road under Sections 90A to 90F of
the Highways Act 1980 and The Highways (Road Humps) Regulations
1999.
 

Content

For reasons set out in this
report the Corporate Director of Sustainable Communities,
Regeneration and Economic Recovery in consultation with the
Executive Mayor is recommended to delegate authority to the Road
Space Manager, Sustainable Communities, Regeneration and Economic
Recovery directorate AGREED to:
 
1.1 In respect of the proposal to reduce the current
speed limit from 40mph to 30mph along Hayes Lane from a point 180
metre south of Old Lodge Lane junction to the borough boundary with
Surrey County Council, to carry out the necessary statutory
consultation in accordance with Local Authorities’ Traffic
Orders (Procedure)(England and Wales)
Regulations 1996; and
 
1.2 to report any objections received following
statutory consultation referred to the relevant decision-maker
being either the Corporate Director of Sustainable Communities and
Regeneration and Economic Recovery, or the Executive Mayor or
Cabinet (as determined by the Executive Mayor) in accordance with
the Executive Mayor’s Scheme of Delegation, to determine
whether to proceed with the making of the Speed Limit Order;
 
1.3Subject to no
objections being received from the statutory consultation, to give
public notice of the Council’s intention to revoke the
current 40mph Speed Limit Order (LBC 2019/46) in accordance with
Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (as
amended) (RTRA) and to make a 30mph Speed Limit Order pursuant to
Section 84 of the RTRA;
 
1.4To report any
objections received following the giving of public notice of the
Council’s intention to make the Speed Limit Order referred to
in paragraph 2.4, to the relevant decision-maker being either the
Corporate Director of Sustainable Communities and Regeneration and
Economic Recovery, or the Executive Mayor or Cabinet (as determined
by the Executive Mayor) in accordance with the Executive
Mayor’s Scheme of Delegation;
 
1.5 Subject to no objections being received in response
to the public notice, to make the Speed Limit Order and to place
the associated traffic signs pursuant to sections 84 and 85 of the
RTRA and the Traffic Signs Regulations and General Directions 2016
(as amended);
 
 
1.6 In respect of the introduction of traffic calming
measures in the form of road humps along the section
of Hayes Lane between its junction with Park Road and Firs
Road, to proceed with the necessary statutory consultation;
and
 
1.7to report any
objections received following the statutory consultation referred
to in paragraph 2.7, to the relevant decision-maker being either
the Corporate Director of Sustainable Communities and Regeneration
and Economic Recovery, or the Executive Mayor or Cabinet (as
determined by the Executive Mayor) in accordance with the Executive
Mayor’s Scheme of Delegation;
 
1.8Subject to no
objections being received in response to the statutory
consultation, to issue notice to the Secretary of State for
Transport of the proposed road humps in accordance with Sections
90C and 90CA of the Highways Act 1980, and Regulation 3 of The
Highways (Road Humps) Regulations 1999; 
 
1.9To report any
comments received in response to the notice from the Secretary of
State referred to in paragraph 2.9, to the relevant decision-maker
being either the Corporate Director of Sustainable Communities and
Regeneration and Economic Recovery, or the Executive Mayor or
Cabinet (as determined by the Executive Mayor) in accordance with
the Executive Mayor’s Scheme of Delegation;
 
1.10             
Subject to no comments being received from the
Secretary of State in response to the notice, to construct the
proposed road humps in accordance with Sections 90A to 90F of the
Highways Act 1980, The Highways (Road Humps) Regulations 1999 and
the Traffic Signs Regulations and General Directions 2016 as
amended.
