Purpose
The report relates
to a Planned Award of a Design and
Build Contract on behalf of London Borough of Croydon
(LBC) for the delivery
of Phase 1 of the “Regina
Road Estate Regeneration Scheme” (hereinafter,
“the Project”).
The Design and
Build Contract will be for the delivery of
Phase 1 of the Regina Road Estate Regeneration Scheme. The
Phase 1 works will include the demolition of the existing
buildings on the estate (except 1-87 Regina
Road which is already being demolished)
and the construction of a phased mixed-use
development providing nine blocks and five dwellinghouses
containing 225 residential units, a pre-school, a community space,
a multi-use games area and associated public realm,
landscaping, play space, refuse/recycling, car and cycle parking
facilities and other associated works.
The initial instruction under the
contract includes the construction of
Sections 1 & 2 sub-phases of the
Project, and the demolition of two buildings. The
remaining sections of the contract will be instructed
under subsequent notices to proceed,
following necessary conditions being met including the
securing of Vacant Possession.
In October 2025 (Decision
- Regina Road Regeneration - Award of Main Contractor for Design
and Build Regina Road combined with Demolition | Croydon
Council) Lovell was approved as the successful bidder
in relation to the demolition and main build contractor procurement
process. This followed an extensive, competitive,
and fully compliant procurement
process.
LBC have
appointed Pellings LLP in the role of Project
Manager to provide expert advice on the procurement and
strategic delivery on the Project.
The Project team have received
procurement and contractual advice from Browne
Jacobson Solicitors and LBC Legal Team to ensure the
contractual basis and procurement processes are robust and
compliant.
The target is
to enter into the Design and
Build contract to enable a start on site before
the 31st March 2026 to
meet GLA grant requirements.
Content
For the reasons set out in the
Part A and Part report and its appendices (Part A and B) the
Corporate Director for Housing AGREED to:
2.2.1.1
Approve the Council entering into a Design and Build contract with
the successful Bidder (identified in Part B) for demolition of the
remaining properties within the estate redevelopment area, and the
main build of Regina Road Phase 1,
2.2.1.2
Approve the Council instructing the successful
Bidder under the D&B contract to:
A)
Deliver Section 1 sub-phase of the development,
including the construction of 30 homes and the demolition of blocks
110a Regina Road and the nursery at 110 Regina Road. The contract
value is detailed in Part B (Appendix A) of this report.
B)
Complete design and due diligence services in
relation to Section 2 of the redevelopment. This is to support the
timely provision of clear, efficient, value for money of the
contractor’s proposals on the next anticipated Section of the
contract. The cost of this instruction to the Council is included
in the D&B contract value as detailed (in Part B
Report).
2.2.1.3
Note that further Key Decision reports will follow
regarding the Council’s approval to instruct the delivery of
subsequent sub-phases of the development.
Reasons for the decision
To enable the Council to enter
the D&B contract with the successful Bidder following
completion of the services required under the Pre-Construction
Services Agreement (PCSA) process, in accordance with the
previously approved procurement strategy and contract award
report.
To support the delivery of the
first phase of the redevelopment of the Regina Road
estate.
To support in facilitating
works start on site in accordance with GLA requirements, to enable
the Council to receive the allocated grant funding.
Alternative options considered
Do
not award the Design and Build contract and do not
reprocure
This option is not recommended
as it would mean that the Council would be unable to deliver the
Regina Road project without a main contractor. On the basis
Successful Bidder was approved as the successful bidder, and the
PCSA services have been delivered as required, there does not
appear to be a rationale for adopting this option.
Do
not award the Design and Build
Enter the Design and Build
contract with Successful Bidder in line with this report
(Recommended) On the basis the Bidder
were approved as the successful Bidder, and the services outlined
in the PCSA have been delivered as required, and the project
remains financially viable; this is the recommended
option. It is also the only option that
allows the project to continue on its
current timetable in support of achieving GLA funding requirements.
This is therefore the recommended option for the reasons set out in
this report.
