RESOLVED: To
 
1.1.        
Approve that the Corporate Director of Sustainable
Communities, Regeneration & Economic Recovery, in consultation
with the Cabinet Member for Streets and Environment and Cabinet
Member for Finance, is authorised to:
1.1.1     
take such decisions and steps as are necessary to
exit the Contract including negotiating and agreeing a final
settlement and novation of any existing contractual arrangements
between Conduent and Yunex Ltd
(Yunex) and any other relevant sub-contractor to
the Council if necessary; and
1.1.2     
take such decisions and steps as are necessary to award a new
contract to a replacement operator and enter
into a novation with Yunex and
any other relevant sub-contractor in relation to existing
maintenance services, if necessary. The contract with the
replacement operator will be the subject of a separate award report
to the Corporate Director and is proposed to include
recommendations for the Chair of CCB to approve the waiver of
certain requirements of the tenders and contracts in order to make a direct award from a compliant
framework.
