LICENSING SUB-COMMITTEES

TERMSOF REFERENCE The Terms of Reference of a Licensing Sub-Committee shall include the functions ofthe Licensing and Public Safety Committee with the exception of the consideration ofpolicy issues,which theLicensing andPublic SafetyCommittee hasreserved toitself.   MATTERSRESERVED TOTHE LICENSINGHEARINGS SUB-COMMITTEE   1.    Decisions required under the Licensing Act 2003 or the Gambling Act 2005,which the law determines cannotbe taken byan officer.   2.    Decisions required under the Licensing Act 2003 or the Gambling Act 2005where the Director Neighbourhoods & Environmental Services considers thatthe existingpolicy doesnot providesufficient clarityon determiningthe application and/or where it would be more appropriate for the application to bedetermined bythe Sub-Committee.   3.    All matters within the Terms of Reference of a Licensing Sub-Committee which arenot reserved to Full Council, the Licensing and Public Safety Committee or a Sub-Committee asstated above,are delegatedto theDirector Neighbourhoods& Environmental Services.   N.B.    The City Council’s Constitution Council Procedure Rule Part 4A rule 44(i) (iv) states that decisions which, in the opinion of the Monitoring Officer, are of aquasi- judicialnature, whichincludes thedecisions ofa LicensingSub- Committeemay not bethe subject of an“Objection”.
