RESOLVED
KEY DECISION
That the Executive:
a) Approved the Enforcement Policy attached at Appendix A to this report.
b) Delegated authority to the Director of Law and Governance (Monitoring Officer) to make any minor or consequential changes to ensure legal compliance in consultation with the relevant Executive Member.
Reason for Recommendation: The adoption of an enforcement policy provides clarity as to the regulatory approach which will be taken by the Council. Adoption of the policy ensures that the Council discharges its obligations under the Regulator’s Code, issued by the Better Regulation Delivery Office (BRDO) pursuant to the Legislative and Regulatory Reform Act 2006.
Alternative Options Considered –
• Each enforcement area to have a standalone enforcement policy covering the specific legislative areas and sanctions in relation to the performance of its duties and responsibilities.
• To not have a policy but to look at each investigation in each area on a case-by-case basis.
• To continue with the policy approved by Executive in June 2022 and not adopt a revised policy.
