RESOLVED
 
KEY DECISION
 
That the Executive:
 

i)              
Noted that that the conditional sale contract
entered with Bellway Homes Limited for the disposal of the site has
passed its conditional longstop date and that accordingly the
Council is under no legal or financial obligation to proceed with a
disposal of the site.
 

ii)             
Noted that there is a possibility that areas of the
Leisure Centre Site may contain parcels of statutory ‘open
space’ and therefore the Executive should:
 

(a)  Taking a
precautionary approach, consider any previous authorisation made
prior to the recent consultation under s.123(2A) of the LGA 1972 as
potentially void; and 

(b) Consider all responses and objections made to
the proposed disposal of the Leisure Centre Land made in response
to the S.123(2A) consultation.

 

iii)           
Having considered those objections and
representations to the public consultation and the options detailed
at 5.2, and their relevant financial and legal risks detailed in
the report, the Executive approved Option C, to Terminate the Conditional Contract and consider alternative
options for the site
 

iv)           
Delegated authority to the Executive Member for
Highways, Travel & Assets in consultation with the Assistant
Director of Assets & Environment to take all necessary steps to
implement the decision of the Executive.
 
 
Reasons for Recommendations: Having considered the public
consultation responses the Executive decided to proceed with Option
C, to Terminate the Conditional Contract and
consider alternative options for the site
