Council

There are three types of Council meeting:   ·         the annual meeting ·         ordinary meetings ·         extraordinary meetings   The Council undertakes the following duties and functions:   ·         Approving or adopting the Budget and Policy Framework, and making any application to the Secretary of State related to transferring housing land. ·         Making decisions on any executive function that falls under the Policy Framework or Budget, where the decision-maker plans to act in a way that goes against the Policy Framework or Budget, unless it's an urgent situation covered by the rules in the Budget and Policy Framework Procedure. ·         Electing the Mayor and appointing the Deputy Mayor. ·         Electing and removing the Leader of the Council. ·         Setting up and defining the roles of Council Committees and Overview and Scrutiny Committees, and, unless required by law, deciding their membership and making appointments to them, including choosing Chairs and Vice-Chairs, unless the Council decides otherwise. ·         Adopting a Scheme of Members’ Allowances and appointing Independent Remuneration Panel members. ·         Determining Mayoral and Deputy Mayoral allowances. ·         Adopting a Code of Conduct for Councillors and co-opted Members. ·         Confirming the appointment of the Head of Paid Service. ·         Confirming the dismissal of the Chief Executive, Head of Paid Service, Monitoring Officer or Chief Finance Officer. ·         Deciding the main delegation of Council (or non-executive) functions. ·         The duty to review the official reports from the Head of Paid Service, the Monitoring Officer, and the Chief Finance Officer

·         Consideration of Public Interest Reports issued by the External Auditor. ·         Receive the annual Pay Policy Statement.

·         Agree a Council Tax Reduction Scheme.

·         All other matters that, by law, must be decided by the Council.   Unless specifically delegated otherwise, only the Council will carry out the following Council (or 'non-executive') functions:   Elections:  

·         Duty to appoint an officer responsible for managing the electoral register.

·         Power to dissolve small parish councils.

·         Power to group parishes together, dissolve those groups, or separate parishes from groups.

·         Duty to appoint an officer to oversee local government elections.

·         Duty to divide a constituency into different polling districts.

·         Power to divide electoral divisions into polling districts for local government elections.   Changing the names and status of areas or individuals:   ·         Power to change the name of the district; ·         Power to change the name of a parish; and ·         Power to confer title of honorary alderman or woman or an honorary freeman or freewoman.

  Miscellaneous functions   ·         Power to make, amend, revoke or re-enact byelaws. ·         Power to promote or oppose local or personal Bills.

·         Power to create rules for how meetings are run. Power to create rules for managing contracts. Duty to ensure proper management of financial matters. (Duty to appoint an officer as head of the authority’s paid staff and provide necessary support.

·         Duty to appoint an officer as the monitoring officer and provide necessary support. Powers related to overview and scrutiny committees, including voting rights for co-opted members.
