Purpose

The Report to Cabinet recommended the withdrawal of
administration and project management functions (the “WDA
Partnership Functions” or “Functions”) carried
out by Joint Waste Solutions (“JWS”) and return those
Functions (previously carried out by Surrey County Council) to
Surrey County Council (“SCC”).  The Functions and related staff were transferred
to JWS under an Inter Authority Agreement in 2018 and are performed
by staff in the JWS team hosted by Surrey Heath Borough Council
(“SHBC”).
The recommendation agreed by
Cabinet was to bring the Functions (and related staff) back into
SCC. This would also return the administration of the Surrey
Environment Partnership to SCC.

Content

Pursuant to the decision made by Cabinet, the following will to
be enacted:
 

1.        
JWS authorities and SCC will enter into an agreement
to give effect to the terms set out below and to confirm discharge
of SCC’s obligations under the Inter-Authority
Agreement

2.        
Eligible JWS staff would transfer to SCC either
under TUPE legislation or COSOP guidelines.

3.        
Existing funding provided to JWS to pay for the
staff and services transferring would be retained by SCC to pay for
the transferred functions.

4.        
The effective date for the withdrawal and associated
actions would be 1 April 2025.
