Purpose

Agreement for the release of a restrictive covenant on Council
owned land that currently benefits another party and restricts the
Council from realising the full potential from its
asset.  The removal of the Covenant will
permit development opportunities to be brought forward.

Decision

RESOLVED –
 
1.     
That the funding required to enable the restrictive
and other covenants (the Covenants) registered against the title to
the property known as Nevill Ground, Nevill Gate Tunbridge Wells be
released on the terms and conditions set out in the Deed of Release
be approved. 
2.     
That the Head of Mid Kent Legal Services be
authorised to negotiate and complete all necessary and ancillary
legal documentation and formalities to give effect to these
recommendations and the release of the Covenants be
approved.
