Purpose
This
report relates to the formal approval of the High Weald AONB
Management Plan, 2024 - 2029, which would become a material
planning consideration in planning decisions.
Decision
RESOLVED –
That the adoption of the High Weald AONB Management
Plan 2024-2029 (5th Edition), (at Appendix A)
as required by Section 89 of the
Countryside and Rights of Way Act 200, for that part of the High
Weald National Landscape that falls within the Borough be
approved.
That the High Weald Joint Advisory Committee (JAC)
be informed by the Cabinet Member that the Borough Council confirms
that it wishes the JAC to publish and submit the Plan to the
Secretary of State on the Council’s behalf be
approved.
That the new Service Level Agreement 2024-2029 (at
Appendix B) between the Council and East Sussex County Council
(Host Authority for the High Weald Joint Advisory Committee) to be
signed by the Cabinet Member with any required minor amendments
delegated to the Head of Planning and Cabinet Member be
approved.
That the revised annual financial contribution for
five years from 2024/25 until 2028/29 of £8,901.00 with a
request for an inflationary increase determined by the JAC
Treasurer for the subsequent four years following 2024/25 as set
out in the Service Level Agreement subject to annual budget
settlements be approved.
That the Draft High Weald National Landscapes Dark
Skies Planning Advice Note (Appendix C) and any subsequent
amendments approved by the Head of Planning and Cabinet Members for
the purpose of development management in support of the Councils
adopted and emerging policy for dark skies be adopted.
That following adoption of the AONB Management Plan
and Dark Skies Planning Advice Note as set out in recommendations 1
and 5 above, training is offered to all elected Members on the
contents and application of the High Weald AONB Management Plan
2024-2029 and the High Weald National Landscapes Dark Skies
Planning Advice Note and that the training so arranged will include
the Council’s responsibilities under the statutory duty for
the AONB under Section 85 of the CROW Act as amended by the
Levelling-up and Regeneration Act 2023 be approved.
REASON FOR DECISION: Adopting the AONB Management Plan would enable the Council to
fulfil its statutory duties in a cost effective and timely manner
and ensure its use for development management purposes.
