Purpose:
Content: RESOLVED That the Executive : a) Formally ‘made’ (adopted) the appended Duddington with Fineshade Neighbourhood Plan and associated Policies Map at Appendix A following the referendum held on 5 September 2024 in accordance with the Neighbourhood Planning (General) Regulations 2012. b) Authorised the Executive Director of Place and Economy to publicise the decision made by the Executive to make the Duddington with Fineshade Neighbourhood Plan in accordance with the Neighbourhood Planning (General) Regulations 2012 – confirming that the neighbourhood plan has been made. c) Delegated authority to the Executive Director of Place and Economy to make any minor typographical or formatting amendments to the Duddington with Fineshade Neighbourhood Plan as appropriate, prior to publication. Reason for Recommendations – To meet the statutory requirements in relation to Neighbourhood Planning as set out in the Town and Country Planning Act 1990, the Planning and Compulsory Purchase Act 2004, the Localism Act 2011, the Neighbourhood Planning Act 2017, and the Neighbourhood Planning (General) Regulations 2012 (as amended). Alternative Options Considered – The Council is required by the Localism Act 2011 (as amended) and provisions of the Neighbourhood Planning (General) Regulations 2012 (as amended) to ‘make’ a neighbourhood plan within 8 weeks of the day following a successful referendum. The only circumstance where the Council should not make this decision is where the making of the plan would breach, or would otherwise be incompatible with, any assimilated law or Convention Rights (within the meaning of the Human Rights Act 1998).
