Purpose: This report seeks to update Cabinet on the current position regarding unrecoverable parking debt and recommends that Cabinet approve the write-off of £12.6m of unrecoverable parking debts bring forward a write-off for 2024
Content: Decision For the reasons set out in the report and its appendices Cabinet RESOLVED to Agree to: i) The write-off of all unrecoverable debt arising from Penalty Charge Notice (PCN) activity, totalling £12,628,658.95. Alternatives Considered a) The £12.6m worth of the debt which has been returned by Bailiffs as unrecoverable is due to a variety of reasons including the warrants expiring, where the debtor is vulnerable or has no means to pay. As per the CPR rules Part 83.3 paragraph 3 a warrant of execution is only valid for a period of 12 months from the date it issued. The alternatives considered to further pursue this element of the aged debt were: · Re-registering the warrants with the court after the expiry date as per CPR Rules Part 83.3. Paragraph 4. However, there are further costs associated with this, which is £10 to re-register each warrant. This is not recommended as there is a very low probability of being able to recover the outstanding debt through further action, as the warrants have already been with the debt collectors previously for a period of 12 months and not recovered. · Referring the cases to Debt Collectors to enforce as a debt or take legal action through a County Court Judgement. In the current economic climate this approach is not recommended as again there is little prospect of recovering the debt owed.
