The Licensing Sub Committee of Cardiff Council was scheduled to consider an application for a personal licence. The meeting's report pack detailed the application and the objection raised by South Wales Police.
Application for a Personal Licence
The committee was scheduled to consider an application for the grant of a personal licence by Nishan Maan James Singh. The report pack indicated that Mr. Singh had provided all the necessary documentation as required by the Licensing Act 2003. However, it also stated that a criminal record check had disclosed information regarding a conviction history, details of which were to be circulated at the meeting.
South Wales Police had been consulted on the application and had raised an objection to the granting of the licence, citing the applicant's conviction history and its potential to undermine the crime prevention objective.
The report pack outlined the legal considerations for determining such applications under Section 120 of the Licensing Act 2003. This section allows the Chief Officer of Police to submit an objection notice if they believe granting the licence would undermine the crime prevention objective. The Sub-Committee, having regard to the police representations, had the option to either reject the application if deemed necessary for the promotion of the crime prevention objective, or to grant it in all other cases. The report also reminded the committee that all decisions must be within the council's legal powers, comply with procedural requirements, be fully informed, properly motivated, and reasonable in all the circumstances.
The issue for discussion was to consider and determine Nishan Maan James Singh's application for a personal licence.
