The Licensing Sub-Committee of Hammersmith and Fulham Council met on Wednesday 29 July 2026. The committee considered variations to street trading conditions and regulations, and also heard applications for temporary event notices. The committee agreed to adopt revised standard conditions for street trading licences and revised regulations for commodities. All three applications for temporary event notices for iMusic Limited were refused.

Variation of Prescribed Standard Conditions and Regulation of Commodities

The committee agreed and adopted revised Prescribed Standard Conditions for Street Trading Licences 2026 and revised Regulation of Commodities for Street Trading Licences 2026. These updates aim to raise standards for street trading, encourage new business investment, and create employment opportunities.

Key changes to the Prescribed Standard Conditions include:

• The minimum public liability insurance cover was reduced from £10 million to £5 million, to assist traders and reduce their burden, particularly for one-off events.
• Wording was added to allow for background or incidental music with prior written consent from the council, to support the unique ambience of specialty markets.
• The conditions regarding electricity and generators were amended to specifically mention diesel and petrol generators, with a preference for battery power supply, aligning with the council's environmental protection aims.
• Wording relating to shop front trading licences on private land was updated to be consistent with other local authorities and to clarify exemptions under the London Local Authorities Act 1990.

The revised Regulation of Commodities provides greater flexibility on what traders can sell, for example, by consolidating clothing categories into a general clothing category.

Temporary Event Notices for iMusic Limited

The committee considered three applications for Temporary Event Notices (TENs) from iMusic Limited, located at ground floor, 10 North End Crescent, London W14 8TQ. The applications were for the sale of alcohol, late night refreshment, and regulated entertainment on the weekends of 1-2 August, 8-9 August, and 15-16 August 2026, with proposed operating hours until 2 am.

The Environmental Protection team, representing the statutory noise and nuisance team, objected to all three applications on the grounds of preventing public nuisance. Their objections were based on the premises' history of noise complaints, a previous noise abatement notice served under the Environmental Protection Act 1990, and four witnessed breaches of this notice, the most recent occurring on 19 July 2026. While acknowledging sound insulation works had been undertaken, the team stated that the continued breaches demonstrated that noise nuisance remained unresolved. They argued that the proposed extended hours would significantly increase the risk of disturbance to nearby residents.

Delia Ruzan, the applicant, explained that the business was in its early stages and that she had made efforts to comply with council advice and invest in soundproofing. She highlighted the financial pressure the business was under due to the inability to operate with extended hours. She also provided an explanation for the breach on 19 July, stating it was a brief birthday celebration where a single song was sung at her request, and that she had immediately stopped the music when informed by officers.

After considering the submissions from all parties, the committee decided to issue a counter notice for all three Temporary Event Notices. This means that the licensable activities described in the TENs are not authorised and the events may not take place. The committee's decision was based on the promotion of the four licensing objectives, particularly the prevention of public nuisance, and the evidence presented regarding the premises' compliance history and the ongoing risk of noise disturbance.
