The Licensing Sub-Committee granted a new premises licence for Pierluigi's Restaurant Limited, located at 86-90 High Street, Beckenham, BR3 1ED. The decision was made after considering representations from the applicant, the Licensing Authority, the Environmental Health and Nuisance Team, the Metropolitan Police, and local residents.

The application sought authorisation for the sale of alcohol for consumption on and off the premises, recorded music, and late-night refreshment, with proposed extended hours. The committee decided to grant permission for:

• Sale of Alcohol (On the Premises): Monday to Thursday 10:00 to 00:00, Friday and Saturday 10:00 to 00:30, Sunday 10:00 to 23:30.
• Late Night Refreshment (Indoors): Friday to Saturday 23:00 to 01:00, Sunday to Thursday 23:00 to 00:30.
• Recorded Music (Indoors): Monday to Thursday 10:00 to 00:00, Friday to Saturday 10:00 to 00:30, Sunday 10:00 to 23:30.
• Opening Hours: Sunday to Thursday 10:00 to 01:00, Friday to Saturday 10:00 to 01:30.

The new licence is subject to mandatory conditions, all conditions from the existing licence, and several new and amended conditions. Notably, Condition 31 of the existing licence was replaced to require acoustic curtains on High Street facing windows and acoustic shutters on side flank windows, to be closed no later than 22:30 on Friday and Saturday nights, and any other nights when a DJ is playing recorded music. Condition 32 was deleted.

Additional conditions imposed include:

• All external areas, except the smoking area, must be cleared of patrons by 23:00 Sunday to Thursday, and 23:30 on Friday and Saturday. No external regulated entertainment is permitted after 23:00 on any day.
• A direct telephone number for the manager on duty must be publicly available at all times the premises is open and provided to nearby residents and businesses.
• A complaints log must be kept at the premises and made available on request to authorised officers of the Council or the Police.
• The Premises Licence Holder (PLH) must surrender the existing premises licence within 21 days of the new licence being granted, unless an appeal is lodged.

The committee considered the history of previous licensing reviews and court appeals related to noise nuisance and operational conduct at the premises. While acknowledging the concerns raised by the Licensing and Environmental Health teams regarding public nuisance, the committee ultimately decided that the proposed conditions, along with the applicant's agreement to further measures, were sufficient to promote the licensing objectives. The committee noted that the applicant's operating model, described as party dinner or vibe dining, involved music that could increase after 22:30, with shutters closed to mitigate external noise. The committee agreed that later hours would assist with dispersal and reduce public nuisance.

The committee also noted that the police did not object to the application, having engaged with the applicant on proposed conditions. The applicant's representative argued that previous decisions by sub-committees had been deemed wrong by the Magistrates' Court and that the current application should be determined on its own merits. They highlighted that Temporary Events Notices (TENs) held over the summer had attracted no complaints and that the noise abatement appeal was ongoing.

Local residents, Mr. Hopkins and Mr. Tucker, reiterated concerns about noise nuisance, patron disruption, and intimidation tactics employed by the premises. They argued that the proposed later hours would exacerbate these issues. However, the committee, after considering all representations, concluded that the proposed conditions would mitigate these risks.

The committee also noted that the applicant had agreed to a Noise Management Plan (NMP) condition, which was considered determinative by the Environmental Health Service. The committee acknowledged the applicant's commercial desire for later operating hours to align with their business model and to facilitate a more managed dispersal of patrons.

The committee's decision to grant the new licence with these conditions aimed to promote the licensing objectives, provide clarity on operating permissions, and support the business's growth while addressing concerns about public nuisance.
