The Employee Appeals Sub Committee of Tower Hamlets Council met on Tuesday 6 October 2026. The meeting was scheduled to discuss the procedures for appeal hearings and the structure of disciplinary appeals. The committee was also to consider an appeal against an employee dismissal.
Appeal Hearing Structure
The committee was scheduled to follow a defined structure for appeal hearings. This structure outlines the process from the introduction of parties and explanation of the hearing's framework, through the presentation of the appellant's case and the manager's case, to concluding remarks and deliberation. The process allows for questions from the members hearing the appeal, the manager presenting the case, and the appellant or their representative. The structure also details how decisions will be communicated, either immediately after adjournment or in writing the following working day. This framework is designed to ensure a fair and thorough review of disciplinary decisions.
Appeals Under the Disciplinary Procedure
The committee was scheduled to consider appeals lodged under the council's disciplinary procedure. The function of these appeals is to review the evidence and submissions made by both the appellant and the council to determine the fairness and reasonableness of the original decision. The process is described as a review, not a rehearing. Key considerations for the panel included whether any new evidence had been presented that was not previously heard, and whether the original decision was procedurally correct. Appeals could be made on the grounds of procedural irregularities, factual inaccuracies, or if the decision did not justify the disciplinary sanction imposed. The panel would assess if the decision was one that a reasonable employer could have made.
Declarations of Interest
A note from the Monitoring Officer was provided to guide members on declarations of interest. This guidance covered Disclosable Pecuniary Interests (DPIs), which include interests of a member, their spouse or civil partner, or someone they live with as such. Failure to disclose a DPI is a criminal offence. Members with a DPI are generally required to declare the interest and leave the meeting room during consideration of the item, unless a dispensation has been granted. The guidance also outlined Non-DPI interests, such as gifts or hospitality over £25, council appointments, or membership of certain bodies. For these, members must declare the interest but may remain in the meeting unless their interest is so significant that it would impair their judgment. The note also drew attention to guidance on predetermination and bias, and restrictions on voting for members in Council Tax arrears.
Exclusion of Press and Public
The committee was recommended to exclude the press and public from the remainder of the meeting. This was on the grounds that the substantive business, referred to as Section Two business,
contained information defined as exempt under the Local Government Act 1972. This typically includes information that is commercially, legally, or personally sensitive.
Appeal Against Employee Dismissal
The agenda indicated that the committee would hear an appeal against an employee dismissal. This would involve the presentation of the appellant's case, supported by evidence and witnesses, followed by questions from the committee. Subsequently, the management case would be presented, explaining the rationale behind the original decision, with further opportunities for questioning. The report pack indicated that the appellant's case was detailed across pages 11 to 92 of the confidential documents.
HR Policy Documents
The committee was also scheduled to consider HR policy documents. The specific content of these documents was not detailed in the public-facing agenda, but they would likely relate to the procedures and guidelines governing employee appeals and disciplinary actions within the council.
