The Licensing Sub-Committee of Croydon Council is scheduled to convene on Wednesday, 4 November 2026. The meeting will be held remotely.
Application to Vary Premises Licence at 1509 London Road, Norbury
The agenda includes consideration of an application for a variation to a Premises Licence at 1509 London Road, Norbury, SW16 4AE. This application, submitted by C M Restaurant Ltd., seeks to extend the provision of late-night refreshment hours from 23:00 to 05:00 daily. The current premises licence, held by KFC, permits late-night refreshment until 03:00 on Sundays to Thursdays and 04:00 on Fridays and Saturdays, with a restriction on in-person customers after 01:00, allowing only delivery services to continue.
Representations have been received regarding this application, which may necessitate a hearing. The applicant has proposed additional conditions to address concerns raised, including:
-
All doors and windows to the premises must remain shut after 23.00 hours, save for access and egress, and in the event of an emergency.
-
A member of staff shall be assigned to inspect the entrance and immediate frontage of the premises on a regular basis whilst the premises is open and once following closure. The inspection shall monitor for noise, congregation, obstruction, and litter, with any necessary remedial action taken promptly.
-
On written notification from the MPS of substantiated incidents of crime or ASB attributable to the premises, the licence holder will meet the Police within 7 days to agree proportionate measures, which may include if reasonable, a voluntarily restriction limiting public access after 00:00 for a reasonable agreed review period.
-
The premises will keep an incident log available to the Police on request and provide a named contact for the Safer Neighbourhood team.
-
The opening hours of the premises shall be, subject to existing conditions restricting access post 1 am to delivery agents, 11 am to 5 am daily.
The Council's Statement of Licensing Policy 2023-28 outlines considerations for the four licensing objectives: the prevention of crime and disorder, public safety, the prevention of public nuisance, and the protection of children from harm. The application falls within a designated Cumulative Impact Area, which means there is a presumption that applications that could add to existing issues will be refused, unless exceptional circumstances are demonstrated.
Representations have been made by an other person
, who has expressed concerns primarily related to the prevention of public nuisance and public safety. The core of these concerns centres on the management of delivery rider activity between 1 am and 5 am, particularly regarding noise, congregation, and obstruction outside the premises, especially given the location on the A23 red route. The representation also questions whether the applicant has adequately demonstrated that operating until 5 am would avoid adding to the cumulative impact on licensing objectives within the designated area. The other person
has indicated that while welcoming the proposed conditions, they do not yet fully resolve the central issue of managing delivery rider activity during the extended hours.
The meeting documents include the Council's Protocol for Licensing Hearings under the Licensing Act 2003, which sets out the procedures for such meetings.
