The Overview and Scrutiny Committee met to review a Cabinet decision regarding library operating hours. After extensive discussion and consideration of public deputations, the committee resolved that the Cabinet's decision was within the budget and policy framework and that no further action was necessary, allowing the decision to be implemented.
Call-In Review of Libraries Operating Hours Cabinet Decision
The primary focus of the meeting was a call-in review of the Cabinet's decision on the Review of Libraries Operating Hours, made on December 10th, 2024. This call-in was initiated by Councillor Rosetti, who argued that the decision was made without a comprehensive library strategy in place, potentially setting a dangerous precedent.
During the meeting, Bob Harris and Annette Pennington presented deputations on behalf of library users and groups. They expressed appreciation for the opportunity to speak but criticised the consultation process, stating it had not been meaningful
and that the third option, which was ultimately adopted by Cabinet, had not been adequately consulted upon. They highlighted concerns about significant cuts to hours at libraries such as Stroud Green, Alexandra Park, and Highgate, and the closure of Wood Green's Sunday service. They requested that the proposal be referred back to Cabinet for further consultation and emphasised a desire for cooperation.
Councillor Emily Arkell, Cabinet Member for Culture, Communities & Leisure, responded to these points, disagreeing with the assessment of the consultation process. She outlined an extensive consultation period held between August 29th and October 10th, which received 1,362 responses and informed the Cabinet's decision. Councillor Arkell stated that the chosen option, Option 3, offered longer opening hours than the alternatives initially proposed and that the consultation was inclusive, transparent, and responsive.
Councillor Rosetti presented the arguments for the call-in, reiterating that a dedicated library strategy should have been in place before decisions on operating hours were made, as mandated by the Council's Constitution. She argued that the absence of such a strategy meant the Council lacked a clear policy framework and had failed to identify potential revenue streams. Councillor Rosetti also raised concerns about the premature release of a press statement before the Cabinet meeting, suggesting it indicated a predetermined outcome.
Councillor Arkell countered that the council had avoided library closures, unlike many other local authorities, and had invested significantly in library upgrades. She assured the committee that the consultation process was compliant with internal guidelines and national regulations, and that the requirement for an annual library plan, removed in 2003, no longer applied. She emphasised the council's commitment to modernising the service and developing a new library strategy.
During the subsequent questions and discussions, representatives from the public reiterated their concerns about the lack of meaningful consultation on Option 3 and the absence of promised meetings. The possibility of further consultation on Option 3 and a longer-term co-design process with the community was discussed, with the public representatives responding positively.
Haydee Nunes de Souza, Head of Legal Services, explained the legal framework for consultations, outlining the four key elements required for a consultation to be lawful. She stated that the council's adoption of Option 3 reflected feedback from the consultation, making the decision lawful. She also addressed the issue of predetermination, stating there was no evidence to suggest the decision was influenced by prior external factors, including the press release which was acknowledged as an error and quickly amended. Francis Palopoli, representing the Chief Finance Officer, confirmed that the decision was in line with the budget and policy frameworks.
At 8:23 pm, the press and public were excluded to allow for consideration of exempt background information and further deliberation.
Following this, the Overview and Scrutiny Committee RESOLVED:
- To agree that the December 10th Cabinet decision on the Review of Library Operating Hours was inside the Budget and Policy Framework.
- That no further action is to be taken, meaning that the key decision could be implemented immediately.
This decision was unanimous among the five members present. The reasons for resolution 2 were based on consideration of the deputations, attached reports, and information shared during the meeting, with the committee concluding that the Cabinet's decision was well-informed and reasonable.
The meeting also noted that the development of a new library strategy would commence after the current consultation process and was scheduled for completion in six months, with a draft potentially presented in July.
