The Licensing (2003 Act) Sub-Committee was scheduled to convene to consider a new temporary street trading licence. Councillor Tonii Wilson, Chair of Licensing Committee, along with Councillors Jane Barbara Lofthouse and Pushpa Dipaklal Makwana, were listed as the members of the sub-committee. The meeting was scheduled to take place at Newham Town Hall.
Temporary Street Trading Licence - Chaii Corner
The main item on the agenda was an application for a new temporary street trading licence for Chaii Corner, located at 40 High Street South, East Ham E6. The applicant, Mr Hasson Hasson, requested permission to operate a food truck (14 metres by 6 metres) in the rear forecourt of the premises. The proposed trading hours were Sunday to Thursday, 11:00 to 02:00, and Friday and Saturday, 11:00 to 03:00, selling chai tea, tea, coffee, milkshakes, milk cakes, fresh doughnuts, fresh fruit juices, hot brownies, and ice cream.
The report pack included several appendices related to this application:
- The application form and supporting documents (Appendix A_Redacted, Appendix A1, Appendix A2).
- A withdrawn noise representation with additional information on agreed time changes (Appendix B).
- A representation from the Traffic, Network & Streetworks Team (Appendix C).
- Responses from the applicant and Highways (Appendix C1).
- Licensing Committee guidelines (Appendix D).
- Standard conditions for temporary street trading licences (Appendix E).
- A street map and street view picture of the location (Appendix F).
The report pack indicated that consultations were carried out with ward councillors, Network Management, the ASB & Nuisance Team – Specialist Operations, Planning Enforcement, the Cleansing Team, the Neighbourhood Officer, Trading Standards, and the Metropolitan Police.
The Commercial Environmental Health Team initially made a representation, but withdrew it after Mr Hasson Hasson agreed to change his requested hours of operation to 11:00 to 23:00, Monday to Sunday.
The Council's Traffic, Network & Streetworks Team (representing the Highways Authority) also made a representation. Jim Jordan, Head of Network Management, wrote to Mr Hasson Hasson to say,
Whilst I appreciate that you will be off of the highway it does not detract from the possibility that patrons to your offering may park on the double yellow lines and cause an unnecessary obstruction to the highway.
Mr Hasson Hasson responded by requesting a three-month trial period to demonstrate that his business could operate without causing disruption. Mr Jordan responded that his thoughts had not changed, and that the representation from Network Management remained an objection.
The Licensing Committee was asked to consider the application and determine whether to grant the temporary street trading licence. The report pack noted that there is no right of appeal for temporary street trading applications.
Declarations of Interest
At the beginning of the meeting, members were expected to declare any disclosable pecuniary interests or non-pecuniary interests they may have had in any matter being considered, in accordance with the Members' Code of Conduct. The Declaration of Interest Guidance document provided guidance to members on what constituted a disclosable pecuniary interest, a non-disclosable pecuniary interest, and a non-pecuniary interest. It also referred to the register of members' interests, and dispensations.
Confirmation of Procedure
The Chair, Councillor Tonii Wilson, was scheduled to confirm the procedure for the meeting, as detailed in the Licensing Procedure document.
